Payday Loan Harrassing Phone Calls

[SIZE=3][COLOR=#222222]Hello. I am having harrassing phone calls from SSM Groups/CMG Groups attorney David Phelps. I had a $300 payday loan from this internet companies last year and made some payments but found out they were fradulent so I had to close my checking account. Now this attorney is calling my home asking for $963 and says he has a court summons for me with felony charges and civil charges. He said I was served but I did not receive the summons because they sent it to my old address 30days ago. I asked them to fax me proof in writing and he agreed but tonight I have not receive anything. What should I do? I gave the attorney my prepaid Visa card for $100 payments starting next week. This is really going to hurt me. I need legal advice fast! Should I contact my banker who helped last year with the fraud investigation or an attorney? Or should I file a police report for these harrassing calls? Anyone that knows anything please email me * Thank you.

As you haven't received the summons, there is no proof that they have send you the same. You did the right thing by asking him to fax you the proof in writing. You should also check out whether or not payday loan companies are legal in your state from the given page:

If they are not legal, then you ONLY need to pay the principal amount to them. They cannot charge you any extra fees.

Unfortunately the calls come and go. Sometimes I go through a period of time where nobody calls for weeks, and then BAM... it's as if another collection agency has taken over and another round of calls start. I have been defaulted in several PDL's for over a year and I have not been arrested or taken to court. Try to work out a reasonable payment to settle your loan. Find out the laws in your state.

Definately find out the PDL laws in your state, and then get proof that this company is indeed unlicensed. If they are unlicensed to do business in your state, the chances of them taking you to court and then winning are virtually zero. If they are licensed, then these chances go up drastically and it is imperative that you work out a payment arrangement with them.
If the company is illegal, as stated previously in this thread, all you should pay back is what you borrowed, the loan principal. You are not on the hook for hundreds of dollars in interest fees, no matter what the company said. You said you gave them your prepaid visa number--is there any chance you can block the payments? Depending on what you owe on your loan principal, my worry is that they will continue to hit this card until their fees are also paid off.
