so ive been dealing with srs and associates since late august.

mr andrews and a few other people have been calling me, refusing to validate the debt or give me an address to which i can send a request for validation. they didnt flat-out refuse, more just kinda danced around the question. im not even sure from where the payday loan came from or how much it was. i did find an address for srs and mailed a certified letter but it was returned to me as "undeliverable".

so after a few conversations with these people i just started ignoring their calls. mr andrews insists that he had his secratery mail me a payment arrangement, which i never got, nor did i ever agree to a payment arrangement. he also says that he emailed it to an account which i told him twice that i didnt have access to.

so basically i take these people for bottom-feeder scam artist who refuse to validate anything. im sorry, but if i called somebody and told them they owed me 600 bucks without proving it, they would tell me to get lost. i would too. who wouldnt? so how can they expect me to pay something they refuse to proove that i owe?

so after ignoring them for a while, i start getting calls (most recently yesterday, dec 7th 2010) from mr andrews again. i have yet to speak with him again, but he assures (via voicemail) me that his office will be "moving forward" on dec 10th. now, while im not losing sleep over this, i am concerned enough to ask the community if i have anything to worry about. they also claim to have a lawyer, ellen epstien esq, as their general councel and she is advising that they move forward as well.

can anybody tell me what "moving forward"entails and weather or not i should be worried?

also, i live in maine and havent had a payday loan since early 2008. unfortunetly, as i said, i dont remember which debt they are trying to collect on or how much it was for.

thats kinda what i was thinking. they havent proved anything and even though they insist that they sent me something, they cant prove it because i got NOTHING. and i still have the certified letter that i sent that was returned to me, proving that I did try to take the proper steps to resolve this.

also, ive already made my boss aware of this situation and he assures me that he will not garnish my wages or honor any type of wage assignment without a court order.

so i think im in the clear. if these people would show me proof that i owe them money ill work with them. but until then they get nothing.

btw, thanks. im curious to see how this is gonna pan out. im pretty sure theyre just gonna try to garnish my wages, but i was wondering if there was an off chance that they may try to actually take me to court over this. any thoughts?

I don't think they will take you to court. However, even if they do so, you'll be safe as you've done your part. You've send them a letter regarding validation of debt. But they haven't replied to it. In such a situation, they are at fault and not you. So, you're in a better position compared to the collection agency.

SRS and Associates are a scam debt collecting company. I am inthe processof sueing them as of the date of this reply. They must by the FAIR DEBT LAW send you a VOD validation of debt. They will also use threats to get you to pay. DON'T PAY THEM A DIME UNTIL YOU GET A LAWYER. I gave them my lawyers number and Mr. Andrews hung up on me. They are being investigated by several states.

These pathetic morons think that they can do whatever they want because they assume that every debtor is a brainless loser that can be persuaded to do what they want.

Unfortunatly today, the brainless loser they set their sights on is the nephew of a district attorney. Now one can Imagine how shocked we were to get a message from SRS saying they were serving a summons on us from the district attorney.

Really??

If you are going to try and lie, do some research before you do it SRS. :p

i love it.of course they get flustered, and frustrated when someone says"take me to court go ahead"as they can't and won't.they want you to be scared and just pay up.you would think once it becomes obvious that the person either knows they are a scam,or says just sue me already.that they are not getting a thing from that person, but noooooo they have to be idiotic and try and pursue anyway.kinda pathetic don't you think?
