I was wondering if someone can help me out and tell me what the CFSA actually does for consumers. I filed a complaint against Cottonwood Financial for not honoring an EPP. Last I was told they had a day to reply back to the complaint from the lady at the CFSA which was before Christmas. I haven't heard from either party. Tonight I got a phone call from Kohn Law Firm down in Milwaukee Wisconsin saying they got the account and wanted to see what we can do to resolve it. Now mind you, I haven't heard back from the CFSA, Cottonwwod to work an EPP out or nothing.

My question is, is this at all a violation of the guidelines? I will be calling the CFSA tomorrow to let them know what's going on and find out on their end the story as well. I told the lady at the firm the situation and she had no idea about the details I explained to her so she asked me to contact them and get back to her by Fri.

Any advice or tips would be greatly appreciated!


Well, the CFSA provides guidelines/Industries Best Practices for members to follow, see the link below:

Their (Their CFSA) statement is member companies are required to to comply with Industry Best Practices, but it doesn't really say what will happen to the member company if they don't comply with the Industries Best Practices. See the link below to read their mission statement:

Have you contacted Cottonwood's corporate office? You might get more satisfaction if you speak with someone in charge at the main office. 972.753.0822.

Also, the EPP can't really be enforced in TX., and CSO's fees and interest aren't regulated in TX.

Well, I haven't contacted corporate offices. I contacted the CFSA right away and put a complaint in. I will follow up with the lady I am dealing with there tomorrow and find out what to do from here. I live in Wisconsin, not Texas. LOL Now that it is in collections or at this law firm, I don't know if I can get it to go back to them or not.

So today I contacted the CFSA and spoke to the lady that is helping me out. She has yet to hear back from Cottonwood as far as my complaint. She is going to be emailing one of the higher ups I guess to get somewhere and she said hopefully some money back as far as interest goes. She suggested I resolve this issue with the collection agency or atleast try to do something as she can't stall for me like she wishes she could until she hears back.

I contacted the collection agency afterwards and spoke to the lady that has taken over the account. She said they can either settle for 1639.28 and have it paid by this month on the 27th or pay the full amount of 2185.71. I told her I am not trying to be bull headed but I will not pay back the 2185.71 as Cottonwood wronged me with the EPP and that is why I got the CFSA involved.

I am just frustrated with this whole situation and dealing with both parties now and not knowing day to day as I am trying to keep it out of legal action.

YAY!!!!!! Things finally worked out. Took the CFSA to get me in touch with the Vice President of Operations at Cottonwood. He pretty much let me set my amount to pay and when to pay so I opted for monthly and have 6 months to pay it off (but will have it paid off before) and they knocked the added interest off.

Pays to be persistant at times and it is amazing what you do when you finally have had enough. I will have the two big loans paid off by April 15th.

Does anyone know how I can go about settling one that is in collections or getting the original creditor to take it out of collections like Cottonwood did?
