Can I Negotiate With The Bank While In Collections?

Hello Everyone,

So I wasn't sure where to turn, I didn't really want to go through embaressing myself on the phone with the bank. So I have this old Best Buy credit card, that I stopped pouring money into, mostly because i'm in debt all over the place, and i'm trying to pay them off in a sort of, most important first, and well, it's been about 5 months now that I haven't payed them.

About two weeks ago I started to get calls from AIC, and i've been talking to the guy to the best of my abilities, telling him it's really tough for me to make payments due to the holidays and such, I'm without a job and rely on my parents, and they have been sucked dry due to the holiday.

I told him that I could pay it off when I get an add-on to my student loan, that will give me somewhere around 3000$ to throw around, the only issue is it's coming at the end of January. The man i'm dealing with is a complete douche (excuse my language) and has been really mean to not only me, but my family also, over the phone. He will not make payment arrangements or anything and he wants the payment in full by tomorrow, or he's going to write it off as refusal of payment to the bank.

Now I was wondering, if I brought all this forward to the bank, letting them know that as soon as i get the money from my loan i'd be more then happy to pay it off, do you think they will be able to do anything for me? regardless of the refusal of payment or not?

Welcome to the forums!
Anna is right. You should contact the bank and explain your financial situation to them. Explain clearly that you and your family are going through financial problems now. But you'll surely pay back the money as soon as you get the loan.

Under FDCPA Act, the collection agencies can't behave rudely with the consumers. If the debt collector has been mean to you and your family, then file a complaint with FTC. You can also contact the State's attorney General regarding this issue.

It is not illegal to be rude or mean....there is nothing in the FDCPA uses those terms.The term in the FDCPA is abusive...threats and swearing is abusive but remember, they are not there to provide customer service.

No, the bank will NOT want to deal with them. Best Buy pays the CA to collect...they are not going to waste manspower talking to the borrower.

Since this is a third party, you can send a certified, return receipt requested letter to them requesting that they cease calling you. In the letter you can state you will get in touch with them the end of January, beginning of February to discuss payment arrangements. State you are not refusing to pay, but that you cannot pay right now, and all their abusive tactics isn't going to make a difference.

You can also tell them that if they violate your request you will consult a consumer attorney for violation of the FDCRA regulations.

It worked with one of my collections, and another I have a pending lawsuit.
