Hello,

I am so relieved to have found this website. Last year, I fell I'll and had to depend on PDL's to make it until I could do better. Now, I'm headed towards financial ruin if I don't get this situation under control. I currently have 7 loans, which are all Internet based:

SSM: 200.00 (paid 180.00 in finance charges)
MMG: 200.00 (paid 120.00 in finance charges)
Little Loan Shop: 300.00 (paid 105.00 in interest)
Ameriloan: 350 (paid 90.00 in Finance charges)
Advantage Cash Services: 200.00 (paid 105.00 finance)
My cash center 2: 200 (paid 151.90 finance)
United Cash Loan: 200 (paid 60.00 finance)

I would be over my rough spot if these lenders would stop trying to take out of my already overdrawn Accnt. I have Bank of America and my checking is overdrawn 1,256.00 bc of those payday loans. And there are other things that were withdrawn and I did not recognize.

I was needing some help in regards to finding whether these lenders are legal or not. I thank God that I stumbled across this website! I would be doing lovely if I could get over this Payday lump. I have learned my lesson.. Never again will I ever take out a payday loan. I was just wondering how many of those lenders are illegal in TX, bc I was unable to locate info in order to see.

I also forgot to mention

Eastside Lenders: 750.00 (paid 225 in finance charges)

Oh my gosh, 1,256.00 overdrawn, and to top it off it's BOofA, they are so freakin difficult to deal with, and not at all understanding, I am quite sure that most (if not all) of those payday lenders are illegal but I need to double check it so hang on until I confirm it. I also want to do some thinking about how to get some of the charges reversed.

The only legal lender you have is My cash center, I am not positive they are legal but I am thinking they are, I still need to do more research on them though.

I am going to give you a couple of links, please read them. Meanwhile, I have a visitor that I need to attend to, I will return as soon as I am available, it may be a couple of hours, but I will return with more info!

The first thing you need to do is close your account, however, I know that isn't possible because of all the fees that BOA has imposed on your account, so, I can tell you what I would do.

I would go into your bank and speak to the branch manager, no one else will do! Explain that you have been scammed by some Internet criminals and need to place a 'hard debit block on your account', also explain that you are in the process of filing complaints with your attorney general's office, the FTC and the Internet Crime Complaint Center. You need this done immediately so these scammers can't touch your account, not only that, but these scammers are known to sell off your account information to other Internet criminals, tell the branch manager all of this, make it known that you are a victim, emphasize that you NEED their help, ask if they will release you from these fees so you can get your account closed. Continued...

Also tell the branch manager there are a number (the one's you have listed included) of Internet Lenders that have disguised themselves as legitimate but are illegally charging exorbitant interest on consumers. There are a lot of state attorney general's that are placing desist and refrain orders on these lenders.

Shazzers,
Thank you so much for the info. I called BofA before you had responded to the question. I explained that these lenders were illegally withdrawing money out of my account and that I wanted it stopped. The lady I spoke with told me that first that I should file disputes on the charges, then she put stop payments on all of the lenders but she did warn me that they could try and send more transactions through. She then told me to keep an eye on my account..She also told me that they will try to recover enough money to zero my account zeroed so I can then close it and open up a new one in order to keep the lenders from getting to it.. She also told me that this happens fairly often.
I did find a CFO on cashstore, but I was very unsure about the other 7. Since the other 7 are illegal, I will be preparing a letter using the template provided in this forum but editing it for my state of TX. Which basically, at least on several of them, I am almost done with the loans since the interest is so huge on such small loans. I will never take a payday loan out again. I will build my own savings up. This has been a nightmare that I hope is ending soon. Im really grateful bc I was ready to spend out huge amounts of money to pay these loans off.
I am looking up contact info for the con artists. I am unable to find info on SSM even though I did read the post here about them. I will be calling the cashstore to set up a payment arrangement or just pay it in full..
Again, thank you so much Shazzers! I will be updating a lot about the progress, and I have a feeling due to what you said, and what ive read from other posts that BofA is a pain to deal with.. If that's so, I'm in for a ride. And I will be going to my local BofA and discussing this further with a manager.

Ok, update. My BofA account is now -176.96 as of a few hours ago. I am going to check again tomorrow to see what the balance is b4 I go to the bank. My account is still in the negative but I can cope with -176.96. I couldnt cope with almost -1300.00 overdrawn. Shazzers, so basically it would not matter which address I used to send to SSM bc all of the companies are affiliated with each other? I will get all of this sent out asap! I'm seeing the dim light at the end of the tunnel... Now let the next step to this begin..

Ok, still have not been able to locate an email so I may just have to fax SSM a copy of my letter. And the other 3 as well, bc I cannot find email addys for the rest of them. United contacted me in regards to my loan through email. I resent them my statement. They sent back that I will have to wait until tomorrow for a response. They wanted me to call and set up an arrangement. How about "No, im not calling you all, and no, the only arrangement that will be made is the one provided on my statement." They do not have my number bc I had it changed on the first of this month. The only correspondence I will be doing with them is via email. I have not heard back from Little Loan Shop, Ameriloan, ot Eastside as of yet. The rest I hope to have sent out no later than tomorrow..

I was just wondering how easy BOA was dealing with this, this morning when I woke up and checked my account they had submitted payment after sending me notice to pay loan via moneygram bc it was kicked back. Now we are negative, but I need to call the bank and have just not had the best of luck with them in any other matters.

Ok, here is an update: I am overdrawn again. All of my money is gone. I'm back 1200 overdrawn. I called BofA again. The charges are still pending so I have to wait until they are returned to get my money back. The agent said that they would likely be returned bc of the merchant names that I have put stop pyment on. I have tried to contact the lenders. Have sent forms, no response but they can send an email regarding their payments though. I will be closing my Accnt as soon as I get my money back since BofA acts as if they can't stop them. Although the illegal lenders sent charges for the full amount and then some. Well, they won't be getting anything else from me through my bank Accnt. And I'm pissed bc BofA officially sucks. I will be going to another bank. I'm willing to pay the illegal lenders what I owe but not a penny more. And they won't get it any other way except money order at this point.

FYI: I don't want to call them bc I refuse to give my number to then in order to be harassed.. Another major issue is that my tax return is supposed to go into my Accnt which is why I don't want to close it just yet but it's clear I will have to.. Back to the drawing board and sending e-mails yet again.

If your tax return bounces back because of a closed checking account the IRS will simply send you a check, I know that for a fact because it happened to me. As far as BofA, I wouldn't grace their steps, nor would I ever recommend them to ANYone, IMO, they are a horrible bank with the worst customer service of any bank I have ever used, and heard the same from many others.
