I sent an email to Christy at Eastside Lenders about my complaint I made to the BBB and my refund of overpayments. WOW these people are amazing lol

I responded through the Better Business Bureau on January 10. My apologies that you have not received a copy yet.

East Side Lenders, which is located in Delaware, is licensed by the State of Delaware to make small loans. All such loans are approved and funded in Delaware, with repayment to be made in Delaware. The East Side Lenders loan agreement and website contain all disclosures required by Delaware and federal law and make it clear that all transactions are governed by Delaware law. On the advice of counsel, East Side Lenders maintains that the choice of Delaware law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Delaware. The loan agreement is legal and enforceable. In responding to your correspondence, East Side Lenders notes and reserves all available legal and equitable objections to the points you have raised.

Per your request, I have included a copy of your loan document. Please refer to the sections entitled Place of Contract and Governing Law, Assignment And Execution. We are willing to settle your account for the remaining principle balance of $425.00. If you are experiencing financial hardship, we will be happy to set up a payment plan that fits your budget. East Side Lenders will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.

Now mind you I had sent an email to her 1/05/11. She said she would respond in 3 business days on the 6th of Jan. I sent a reminder today and the above response is what I received. I have already overpaid this company by $602.50.
They don't get that they are illegal in my state.
Any advise in a response to this?:p


Each email I sent to them has resulted in the same response. Although I haven't heard from them at all since I was able to get my bank to reverse two payments they debit after I revoked my authorization and told that they had violated Delaware law by giving me a small loan when I asked for a payday loan- can you say bait and switch. tsk.tsk

It is very unlikely you will get a refund from Eastside. You can read all the past posts from people who've dealt with them including myself. I continued to receive the same e-mail to which I resent my original e-mail. After approx. 3 months or so, they turned it over to a scum-bag collection/lawyer service - and we did the pdl dance for months. Finally, they went away.

I would contact my state authorities and file a complaint that Eastside is illegally lending in your state. I wouldn't count on Delaware or the BBB to help. If you file complaints with your state, perhaps if they get enough, they will move on them like other states have.

yeah keep sending the email with the info stating you overpaid,and will not settle for less than a refund.also either file AG complaints,or follow up complaints.it makes me ill when they put that they are commited to serving their customers.what a laugh,they should be commited...to an institution.

All you have to do is pay back what you owe since you have only paid one fee. The amount is 425.00. We can stop all the fees and split into smaller payments if its easier. You agreed to the terms when you got the loan.[/COLOR]

Because I follow WYOMING laws, I only owe you the balance of what you originally gave me. So, $400 less the $140 you pulled out of my account is $260. As soon as you agree to that amount, I would be happy to pay you. Until then . . .
