I received a call at home this evening from Peachtree Law center. They initially asked for my wife, I said she was unavailable and asked to take a message. At this point they said they were trying to reach me. They said they were calling in reference to a PD loan from 2 years ago (that I believed to be long since paid off) and that I needed to make arrangements with them to prevent potential legal action. I explained to "Courtney" that the amounts she was stating didn't match anything and that I believed it to be paid off. I told her I would need to research it and call her back. I did call back and she handed me off to a "manager" named "Mr. Rogers". Mr. Rogers told me that if I didn't agree to pay the $730 right then, I would immediately be assesed upwards of 4500.00 in fees and I would be sued.

I told "Mr. Rogers" that this was the first phone call, notice, etc I had ever received regarding this and that per FDCPA, I wanted something in writing. He told me I was not entitled to since the law firm owned the debt. None of that makes any sense. he told me I have until 10am tomorrow to cal him back and make arrangements or what they claim I owe will go up 500%. Is this legal or am I being scammed. If I do indeed owe, I want to make good but I don't want to get hosed in the process.

The company name is Peachtree Law Center. They called from 720-306-0270 and gave me a callback of 888-497-4454.

Immediately send them a debt validation letter and include that since they contacted you by phone,. they now have 5 days in which to send you a dunning letter. Also include a limited cease & desist that all further communications will be in writing and no further phone calls are to be made.

Call him back and tell him that he is overshadowing your right to dispute the debt by giving you only till 10 am the next day when you have 30 days to dispute said account. Also inform him that he DOES NOT have the right to jack up the account by 500% and that should he sue and win, he would only get the amount of the account, legal fees and state allowed interest. But to even get THAT he will have to prove you owe him anything in discovery as you will file discovery demanding all documentation.

Inform him he has already broke federal laws regarding this alleged account and you will not tolerate this, that you are filing complaints with the state bar of his state, the ag of both his and your state as well as the FTC.

I am thinking this is a scam, or just another scum sucking debt attorney who tries to threaten and intimidate people into payments. Do not let him do this to you. You have rights.
