I have read through a lot of the posts here and gotten some very good advice. Thank you for that. The only thing I cannot come up with is the answer to a specific question I have.

My fiance lives in Florida and had a payday loan with JVC Funding which she got online and paid part of until they started taking more money than they were supposed to on dates that hadn't been agreed to. She put a block on all ACH debits from her account and paid the fees that accrued from their activity. Now a company Peachtree Law Group is calling and demanding payment for the JVC Funding account. They have threatened to have a warrant issued among other things. I know from reading all the posts that they cannot do this. She wants to take care of this but they are demanding $760 in three payments of $254 plus a $10 processing fee per payment.

Okay so now the questions

a: Is JVC Funding legal in Florida for online lending?

b: Is Peachtree Law Group an actual company that she should be dealing with to pay off this debt. They give an address of 2600 S Parker Rd suite 359 Aurora CO 80014.
and a phone number of 800-668-6163

c:If this is a legitimate company, how much does she have to pay. The original loan was for $300.

well i can state a couple of things.

1)jvc is not legal in florida as no internet is legal in fl
2)that being said anything debited in "fees" prior to closing that account goes towards the loan,and she is only liable for the 300.00 borrowed.
3)this loan is not enforceable in court so the threat of arrest is illegal,and against the law.
4)this bottomfeeder just started in 12 of 2010 so they are another scammer that just popped up.

i would file a police report as again the idiot broke the law with that call,and file FL,AND CO AG complaints against this bottomfeeding scam collector.see what was debited by them as again since this was an illegal loan.she is only on the hook for the 300.00 and anything debited goes toward,or gets dedutced from the 300.00.you will be amazed at how little if anything she truly does owe.

I have noticed a couple of members mentioning PeachTree Law Group trying to collect on an illegal lender, so they must be getting into the payday loan industry. Maybe they are unaware of the loans being illegal, or maybe they already know, only one way to find out, communicate with them via the mail, let them know you are aware of your rights and intend to keep a record of all their attempts to communicate with you, also make it known to them you fully intended on reporting them to the FTC is they fail to comply with the FDCPA.
