I am 100% totally disabled. I am in dept over $25,000 to 2 credit companies. Can the garnish any payments from my Social Security disability check or from my disibility check I receive from the company I worked for when I became disabled. The credit card colection agency's call almost every day. I cannot pay them any amount of money unles I go without medication, or food, or rent..etc.


Creditors are not able to garnish social security disability benefits, except under very specific circumstances. Credit card companies, finance companies, auto lenders, etc, can never garnish SSI. Do you have a checking account? If they take you to court and win a judgment, they may be able to levy your bank account. You could have that levy reversed due to the only funds being deposited into your account are SSID but, it's a hassle. You may simply want to let these people know that you are judgment/execution proof. See the letter below.

(c) CEASING COMMUNICATION. ???If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt??????

Although I agree that I owe this debt, I am unable to make any payments toward it and therefore ask that you cease further communication with me concerning this debt. I will notify you if my financial situation improves enough to allow me to begin or resume making payments. Thank you for your understanding in this matter.
