i received a call this morning from a collection agency, saying that if i don't come up with $1300 by 4:00 they are going to proceed with legal action, I have been making monthly payments to this agency which was accepted by the them. Can they proceed with legal action, and what can I do to stop it.

If you're already making monthly payments to the collection agency, then they cannot take legal actions against you suddenly. Did you ask them to clarify why they want a payment of $1300 suddenly when you're making monthly payments on time? If not, then you should contact them and clarify the matter.
