I took out a payday loan at Quick Cash in Boise Idaho over a year ago. I defaulted on that loan. Yes, they called me and everything, but, i didnt have a way to pay them back. Now I am getting harrassed by some guy (3rd party collector that bought the debt), he said I can be arrested for writing a bad check. The loan was for 300 total check was for 360. I have not heard a word from Quick Cash in a long time. Now all of a sudden this creep is calling me saying they are going to have me served with court papers and charge me for negotiating a bad check out of state....I still live in Idaho. quick cash is in idaho..it was not an out of state check. They have called me 3 times today alone. Can they do this? Do I need to worry about being taken to court and charged with a crime like this? :confused:


Hi, I am checking your state laws. One thing, if he calls again, tell him he is required by federal law (FDCPA) to send you a dunning letter (letter of collection), and it's suppose to be within 5 days of his first contact with you. NEVER admit to owing a debt over the phone, regardless of whether you owe it! What is the name of this 3rd party collector?

Well, he is lying to you about writing a bad check because in Idaho, criminal action is prohibited! Your payday loan laws are below:

If a 3rd party collector has purchased this debt, then they need to follow through with the FDCPA, you REALLY need to file a complaint against them asap for making bogus threats against you with the FTC. The link is in my signature. Meanwhile, tell him to put his money where his mouth is and send you that dunning letter, or STOP calling.
