Question on Attorney General Complaint

Hello all! I have sent off all of the emails to my illegal PDLs and gave each of them 48 hours to respond to my request for a PIF letter, and their time is about up, with no repsonse.

So, my next step is filing my complaints with the SC Attorney General and the FTC. Does anyone know where I can find a sample complaint letter? Should my complaint be filed online or via certified mail, or does it matter?

Thanks Shazzers! Knew I could count on you to come through! As I went to the AG's website, it seems that for SC, complaints are filed with the Department of Consumer Affairs, in case anybody else out there is from SC and needs to know...

There is no official sample letter....most AG offices have online complaint systems. I found NY's to be hard to use, so I ended up drafting my own letter, which I am happy to say has actually spurred their office to action, on 9 different accounts!

Dear Sir or Madam:

I am writing this letter regarding a service I received from SCUMBAG PDL COMPANY, an internet pay day loan provider.

My account number with SCUMBAG PDL COMPANY is #XXXXXXX, but perhaps they can also access it with my name and address, and the last 4 digits of my SS number, which is XXXX.

SCUMBAG PDL COMPANY is charging interest and fees on a short term advance that is well over the allowable XXX% in YOUR STATE, as per YOUR STATE's Usury Law. On XX/XX/XXXX, $XXX was deposited in my checking account. Every two weeks there after, $XX was debited from my account, using ACH transactions, until a total of $XXX was reached. It is then I learned that these interest rates could not legally be charged in YOUR STATE. However, despite the principle being paid back in full, plus $XXX, they insist on collecting on this, as I understand it, illegal loan.

$XXX has been sent to this company via ACH transactions.

I contacted Customer Service on XX/XX/XXXX, and explained that the service was unsatisfactory due to the exorbitant and illegal interest rates. They responded and asked if I were referring them to the Attorney General, to which I replied not unless they didn't close the account immediately, as the $XXX deposit was paid back, and the interest fees were null and void in YOUR STATE. They referred the account to a collection company in ANOTHER STATE, SCUMBAG COLLECTION AGENCY, which attempted to collect an additional $XXX to “close the account”. I responded that I considered the account closed, as over $XXX had already been paid, and that I was refusing to pay another dime. Failure to receive an appropriate response to this issue has prompted me to write to directly to you.

I would appreciate your assistance in resolving my complaint. What I would like is confirmation from this company that the account is paid in full, from SCUMBAG PDL COMPANY. The initial deposit of $XXX was made to me on XX/XX/XXXX, and $XXX payments to SCUMBAG PDL COMPANY were made on XX/XX, XX/XX, XX/XX, XX/XX, and XX/XX.

Obviously...there is some stuff here that may not apply to you, and you obviously would replace some verbiage with actual names, numbers, and dates....but there you go.

UPDATE: I received a response from Greenlight Funds today!!!! They have agreed that the only amount I owe is the principal that I borrowed, and I have already repaid $150 of the original $300, so now I only owe them $150 - and we worked out repayment arrangements of $50 per month for January, February and March!!!! One down, a LOT still to go, but hey, it's a start and I'm happy!
