hey guys ~
I'm hoping someone can help me. I received a summons from this crooked law group (yeah I looked them up and they are a bunch of snakes) for an old Bank of America credit card I had in 2008. Due to financial circumstances (lay offs, etc.), I have been unable to make any payments. I owe them about $4k. I called Brachfield today and they offered me one of two "settlements"
1 - pay the amount in full next month
2 - pay $2200 with $1300 up front by the end of the month and pay the rest by the middle of Febraury.

Both settlements are jokes. First of all, how is the first offer even a settlement? I tried to work something out with them because I'm unemployed and things have gotten so bad I had to get on food stamps! I explained that to them and all I got was "yeah, I'm sure that's hard. so, which offer do you want to accept?" It's obvious they want my income tax refund because they advertise it on their correspondence "it's tax time and we have great settlement offers!". Great my a$$.

My question is - what should I do? Should I just go to court and explain everything to a judge and see what happens? The crooks at Brachfield are not willing to entertain any counter offers - it's their way ONLY. I don't have the money to make any lump payments to them and I need my income tax refund to fix my car so I can have reliable transportation to get to job interviews as well as get to work, when the time comes.

Please help. I received the summons last week and know that I have only 30 days to respond.
