Can Hilco sue me for $1700 credit card debt they bought? I'm in Texas....I was served with papers! I don't know what to expect..

If the Sol period on the debt has not expired and you have defaulted on the credit card debt, then the collection agency can sue you. If you have been served with summons, then I would suggest you to contact a lawyer. He will help you in answering it. If you don't give a reply to the summons or don't attend the court hearing, then the judgment may go against you. The judge may issue a judgment order against you. Thereafter, the CA can garnish your wages if it is allowed in the state of Texas.

You can also try out of court settlement. This way, you can avoid the legal hassles. Once make a settlement agreement, ask the CA to withdraw the case against you.

Have you made a payment on the account within the last 4 years? Texas SOL is 4 years so if it is older than that you have an affirmative defense. Also you want to deny their claims and demand validating documentation during the discovery phase of the court case...you want to do this before claiming SOL, because any amount over $600 will get taxed and you will have to pay taxes on it.
