Summons threat is it real???

I had some payday loans back in 2009. I closed my account and sent out letters that stated the interest rates that they were charging were against my state's law (which it is) I stated that because of the payments I had made equaled or was more then the amount I borrowed my debt was paid in full. I recieved letters back from 3 of the 5 stating that they were marking my account paid in full. As for the other two I never heard anything again until this week. There is a company calling me stating that I wrote a "bad check" (the ACH debit that did not go through). They now have a summons in hand for fraud. I told the company who would not state their name clearly that I wanted verification of the debt since they would not tell me what payday lender it was through. The person on the other end stated they did not send out verification since it was now a legal matter and all the information would be in my summons. I told her to go ahead and serve me that I would be at home that day at 4:30. Guess what no one showed up...They have also been calling any realtive of mine that has the same last name as me that is listed in the area and been leaving personal information on their answering machines. Is there something I should do? Should I be worried?


I'm just curious which company is the one making the threats. I'm dealing with the same situation myself and have contacted the PA Attorney General's offices, the CT Attorney General's office, the BBB, and the FTC. This one particular group has called my parents, my uncle, and have yet to actually send me proof of debt after I sent them a CMRRR letter. I asked them to stop calling, have e-mailed them three times after they continue to harass me by sending me e-mails with pictures of people in handcuffs, and more.

Seems these scams are reaching epidemic proportions anymore, doesn't it? Tell your family members etc., who are being harassed that you're the victim of fraud/identity theft and they should hang up on anyone who calls them with such messages. If the scammers are sending threatening e-mails w/ photos etc., I'd DEFINITELY report them to your State Attorney Generals' office as well as your States' financial regulatory agency. I'd also mark their e-mails as 'spam.'

I wish I knew what company it was, but they will not give me any further information. I am going to try and call them again this afternoon and see if I can get the name of the company and the name of the "locater" company they use. When I complained about them calling my family they said that they out source the responsibility of locating me to another company. They also said they only contact the people that I used as references...funny thing is, I just married into this family in Oct. didn't even know these new family members at the time I supossivly "used" them as references

So I called the number again and this time I was able to get the "company" name out of them they call themselves Johnson walker group. They told me they were not able to tell me the name of the company that they out source to for locating people. I told them that the company was leaving personal information on strangers answering machines. They would still not tell me the company's name but did give me a number to a supervisor...1=877-285-770 ext 140. We will see what happens. Any advice is appreciated.

sorry my number buttons sometimes stick...kids. again it is 877-285-7706 ext 140. And they can not say it is check fraud for an ACH debit not going through...thank god! If I really do owe this I have no problem paying back principle amount, but I do need to know the company the original loan was through :(

Well, if you are being called by a 3rd party collector (an obviously you are) do NOT admit to owing a debt over the phone! Tell them, as a 3rd party collector they are bound by federal laws (FDCPA) and are required to send you a letter of collection via the mail within 5 days. Just the fact that they are making bogus threats (check fraud) speaks volumes about their unethical business practices, so you can NOT trust a voice on the phone, whether you owe it or not is irrelevant.

Small update, recieved and email from this Johnson walker group. It stated that since this was a payday loan they could not send any paperwork because there was not any. Attached was an email adressed with someone elses name stating how much I owed and from what company they bought the debt, which I do not believe was one of my payday lenders but I will check my files. I told him that I wanted a letter of verification sent to me via the us postal service and he is refusing. Just telling me that the email should be verification enough and if I did not make arrangments they were going to sue me for fraud.

again more illegal threats as to sue you must be served and an email is nothing.the fact they won't send anything via USPS is a giveaway as they don't want you get their address.these bottomfeedrs are so transparent it's sickening.btw you don't get sued for fraud,fraud is a crime and you can't be arrested for owing a debt.again ridiculous.if you have filed the complaints do not talk to the idiot further.a waste of your time.

My sister in law received a call for me today saying had a court summons and also needed to call 877-285-7706, after reading all of these comments Im going to tell her the same thing, If they call back they need to contact me by mail. The person who called her said it was a civil matter, for child support or a divorce. Im married and dont have any kids! This is crazy!!

I have received phone calls at work, home and on my cell phone. These callers have been extremely rude to my co-workers and are very adamant about reaching me. They also call from several different numbers. I did not start receiving these calls until I had a few on line payday loans owed. But the caller made several mistakes about these so called defaulted loans. They claimed that the loan was for $300 then $400. They also said that the loan was issued in 2009 and I had never taken out a loan till 2010. And all of the callers talk with an Indian dialect. They had treatened to have me arrested. They had also stated that I had appear in court. I in turn went along with their statment to appear in court and asked which court do I appear at and when. I don't think that they expected that response because I got to different answers. One from the so call collector and the other from the so called manager. On another ocassion I went along with another of their calls and I asked what company do I owe and how can I make payment arrangements? I was informed by this so call collector that there are several payday loan companies approx. 20 under one larger company and that anyone of these companies could be the one I owe the outstanding debt to. I asked if I could make payment arrangements by check, money order or western union and the collector response was NO! He stated that the payment could only be made by credit card. SCAMMERS. I informed my phone company of these calls and the operator informed me to dial *57 to trace the call. But you have to do it before another call comes thru. You need to trace the same number twice. The first time you do it, it will register with the phone company. The second time it will register with the police department fraud unit. I hope this was helpful to anyone needing it.

So just another quick update, after the email that was a standard form letter I recieved two more phone calls one of them was from the johnson walker group again. I told them that the email was not debt validation and needed an address, they refused. I then told him to hold on so I could turn on my recorder. I then told him the phone call was now being recordered and asked him to repeat why he would not give me an address to send a DV letter to, he hung up. The next day I recieved a phone call from the orignal lady who works for the "locator service" again she was saying the same thing that if I did not call this number she would be forced to have me served at work or at home. I told her that I was at work at the moment but I would be happy to meet whom ever at the local police department which is 2 minutes away, no reply from the voice on the other end. I then told her that if she would like to wait until 430 I would be home and that the door to my apartment was around back of the building and if she sent someone cute I would answer the door in my underwear. She hung up on me...how rude! My family and I have not heard from them since. I am sure it will start up again when my name gets "sold" again but this time I won't stress.
