I have filed Chapter 13 bankruptcy back in April 2010. However, now I am finding it quite difficult to make payments as per the payment plan. Can I convert my bankruptcy case from Chapter 13 to Chapter 7? Is it possible now?

Yes, it is possible to convert your bankruptcy case from Chapter 13 to Chapter 7. Under 11 U.S.C. ? 1307 (bankruptcy code), you can switch over to Chapter 7 bankruptcy at any given point of time.

You need to consult with an attorney in your area. While you can convert, obtaining a Chapter 7 Discharge may turn on whether or not you "qualified" for a Chapter 7 as of the original petition date. Qualification is based upon your median income when you filed and, if you were above median income, "means testing" as of the original petition date. If there would have been a "presumption of abuse" you may have to overcome that presumption. Other jurisdictions don't care.
