Phone Calls From Debt Collectors- What Do I Say / Sample Validation Letter

1.) If you receive a call from a collection agency, DO NOT admit to owing the debt over the phone, as far as you are concerned it's only a voice over the phone and should be treated as such until you are certain (documentation) they are legitimate and following the law!
2.) You are protected by the FDCPA (Fair Debt Collection Practices Act), these laws are designed to protect you from scams, therefore you should exercise your rights.
3.) Ask the voice on the phone; their name, the full name of the business (ask them to spell it), their address, and a direct telephone where THEY can be reached, next, proceed below.
4.) Tell the alleged debt collector they have 5 days to send you a dunning letter (also known as a letter of collection)
through the mail, tell them you are counting the days and keeping a record of all communication to make sure they are complying with the federal law (FDCPA).
5.) If the debt collector refuses to give you any information that is a BIG RED FLAG. Do not give them any of your personal information, do not admit to owing any debt, and do not discuss anything over the phone.
File a complaint immediately with your state attorney general and the FTC.
6.) If and when you receive a letter of collection, you will send them a debt validation letter, certified, return receipt requested, it is extremely important that you send the debt validation request certified. You can obtain sample debt validation letters in the DIY section of this forum.
7.) It is VERY important that you respond and dispute a letter of collection within the 30 days of receipt, don't take any chances, send the debt validation letter immediately, make sure you date it and keep a copy. Again, keep a record of all communication a collection agency attempts to make with you.
8.) Educate yourself on the FDCPA.
This is a sample debt validation request letter for a collection agency of illegal online payday lenders. This letter should be sent after you receive a dunning letter (letter of collection) in the mail. Anytime you receive a telephone call demanding payment for a payday lender (3rd party collector) you should tell them you will not discuss this matter to a voice on the phone, instead, tell them to send you a letter of collection through the mail within five days of their first initial contact, or you will file complaints against them with the FTC for non compliance of the FDCPA laws.

i just got off the phone with a man named "charles" from 713 422-2752 (1 866 402 4043 was the number i was to call back). He left a voice mail saying just as the others have said was told to them; important business matter, have me or my attorney call back.
I called back and he asked if I was who he was looking and had me confirm my social sec. number. He then went in to say he could put a hold on the interest and late fees on a payday loan from years back. Also that i had a debt of over 900.00 because of late fees but also that i was making payments. he then went on to say i could settle the debt 2 ways
1. payments over 3 month period
2. a lump sum of half the balance
when i informed him i could do neither due to my income, he said i could close it by Friday for 200.
i just want to know if its a real place that would actually clear the debt and can i still only pay the 200 after (if at all) i receive something in writing; or a scam and i would still have the debt and be out 200 bucks.

you may want to add that it is only illegal to say they will hold off on filing suit if in fact they do not intend to file a suit. Also, usually if you call the original creditor they can give you contact numbers to who they sold the debt to or who is collecting for them. this may also help give confidence that you are giving your money to the correct agency and not to a scam.

But what about when you are just starting out and the original PDL is looking for their money? Do I talk with Nationwide Cash or Zip19 and tell them I can't pay them? I have gotten a few payday loans and my husband got laid off so I am the sole money maker at the time and had to stop the deductions from our account.. He and I both now get very ugly threatening calls, that some leave Voicemails and others just keep calling saying things like : I am calling from such and such law firm, if you do not call me back and pay this debt you will have people on your door to arrest you" or "I have people on their way to your home at XXX then the say my address and they will be picking you or the money you owe up".. trying to frankly scare the poo out of us. I am sure they are not legitamate because when I was brave enough one day to point out you cannot arrest someone without first presenting them with papers to give them time to clear the mess up they hung up on me. I have them calling my work and I am frankly scared it is going to cost me my job! I need help but have no idea where to go - I tried this company called Paydayloan help and all they did was take around 600 from me and then nada! Any help would be most appreciated, I am not saying I won't pay these back but can't right now and can't afford for them to keep making the debt go up with late fees etc. HELP please Thanks so much and so happy I found this site.

I told him to send me a validation letter with the debt information in it. He said he wouldn't and started screaming at me. Then I called back and asked when I could expect my letter and he said and I quote "stop wasting our time I'm taking the matter to the court!" Needless to say I don't have a loan with Nationwide US Cash? Does anyone know who this is????

I have a letter of collections from Alliance Asset Management who is representing Cash Direct Express (aka GECC). They claim I owe $778. It was for a $400 loan which I have already paid back $560. They are NOT licensed in the State of Texas.
Anyway, I never contacted them, and I received this letter:
This is an important notice. Your delinquent account has been placed with Alliance Asset Management, Inc. for collections. Per the terms of your agreement with our client the balance in full is due. That should be a big "red flag" clue that they are not legit because they CANNOT arrest anyone for two reason: First, they are not law enforcement officials, and secondly, it is a civil matter, not a criminal one. And, as you pointed out, they cannot do a darn thing without properly serving papers and obtaining a valid court order.
At that point, calmly point out that what they just told you (about treatening an arrest) violates the FDCPA.

I live in Western NY, and there are literally dozens of bottom feeder CA's around here, and you wouldn't believe the hemming and hawing some of these guys do when I see these workers out at the clubs and such, and I drop knowledge on them I obtained from this site. It's HILARIOUS. A couple know, however, and pretty much told me they didn't care because so many people are unaware of their rights that they just pay. Sad.

Not all info is passed from one collection agency to another. Most of the time when a debt collection agency looses or fires a client causing the original creditor to place with a new agency, the old agency will erase the files so the next agency can not get the money that they were unable to collect. So it is common for a second placement of the debt to not have updated information.
IAG Threat to charge sue me for bank fraud and theft by check
I received a call today from IAG, Mike Hall. I pretended not to know anything about what he was talking about. I asked him the amount I originally owed and he said he could not tell me but the suit would show $1693.57. When I asked who his client was he said DSI Lending Resources. When I told him I did not have any dealings with this company he then said it was PaydayOne. He tried to get me to settle for $520.18 today, when I told him I would not do that and that I need to do some research on what he was telling me he said he could offer me a settlement of $683.57 and that I had three months to pay it, but one payment would have to be within the next 10 days. I told him I could not do that. He said he would hold my account for 24-hours. I needed to call him back or they would proceed. Should I call and work this out? Or is this a third party collection?

Same exact letter, just with Cash Cure
I received the same exact letter, even down to the "Mr. Dwyer" at the bottom of it, a couple of weeks ago. In this instance, mine is for Cash Cure, with whom I had an advance of $400. I've already paid them over $600, and will certainly not pay anymore. By the way, I'm in Kentucky, where the loans are illegal. Here's my question: Should I send that same letter to Alliance Asset as the CA or to Cash Cure, the original lender? Or does it matter?

KATLYN WAHLBERG is especially nice and a gifted SCAM ARTIST! Do not give this company ANY personal information. I called my bank and my lender (loan paid off already) and all was fine. Unfortunately, I gave the wicked Ms. Katlyn Wahlberg my VISA. Luckily, my bank closed my VISA before they could steal my money.

I called back without letting on that I knew they were scam artists. I told them my VISA was no longer valid and could I have their company name and address, so I could mail them a cashier's check. They refused to give it. (Because there is no company or valid address).
I then said, "It's so odd, my lender has never heard of you. Isn't that odd Ms. Wahlberg?" I then said that she would be cursed for the evil and misdeeds she had done to innocent people. And that all the harm she has done to people would come back to her and her family tenfold." She started screaming in fear and sent me off to the fake Ms. TINA WEST...who then attempted to curse me back in a fumbled attempt. I laughed at them and hung up and blocked their number.
