I am to a point of negotiation, but really need to know how to minimize the buyouts. I have paid a few of these guys well over the principal (in finance charges), but how do I handle it all?
I haven't sleep well for the last week just stressing out over all of this and I really need some help.

ipdl's still have to have a license to lend and if they don't then you only owe the principle.as far as BSof A goes.google the EFT act(electronic funds transfer)act.you can revoke ACH debits at anytime.print that out and take it to the branch manager.that is a federal law they have to obey it.answer those questions and we can help you here.

Okay, BofA was AWESOME!! They shoved back ALL the ACHs and I closed my checking account officially today. I just reopened a new one and move my money back into it.
Now it's on like King Kong in the battle against these SOBs. I am going to start firing out the letters now. Should I also send out a C & D letter? Or does this letter cover that part? I really don't want them contacting my place of business.

I am also in AZ and was in a similar situation about 5 months ago. Here is the letter I used and ended up with PIFs from all but one lender. The last one I have just never heard from again. Good luck and be strong!!I have recently become aware of the fact that as of July 1, 2010, payday loans are illegal in the state of Arizona. (Please see attached letter from Arizona Attorney General Terry Goddard) As such, all loans made to residents in the state of Arizona under $10,000 are subject to the Arizona Consumer Lending laws which require all consumer lenders to obtain a license from the Arizona Department of Financial Institutions. (Please see attached Arizona Consumer Lending laws) Upon searching the ADFI database, I am unable to locate a license for your company. If I am in error regarding your licensing status, please provide me with your license number so that I may verify its status with the ADFI. Since your company is not licensed to lend to residents of the state of Arizona, the loan contracts I entered into are void and unenforceable, regardless of the laws cited in the contract itself.Effective immediately, I hereby revoke any and all ACH authorizations with your company from debiting any and all of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I also revoke any and all wage assignments I may have signed, including but not limited to; any of your affiliates, dba's, and collection agencies assigned to this account. I have forwarded copies of this revocation to my employer???s payroll department in the event you attempt to act upon the revoked wage assignment. If you read AZ law it would appear to indicate that an illegal lender is not legally entitled to even the principal amount, however this site has always advocated that there is a moral obligation to repay at least what you borrowed. In my case, I had only one lender that I had not fully repaid and I offered to pay the remaining balance on the principal amount to close out my loan (It was about $50) They agreed and that was that. So you would have to alter the letter to say something to that effect. As far as how to send the letter I was fortunate enough that fax and email worked with all of my lenders. I know some fols have had to send things through the mail so I guess it just depends on how your lenders respond. I would not use your personal or work fax, though. I found a couple of good online fax programs that you can upload everything right through the internet and generate a fax that way. Just precludes one more avenue of contact. Good luck!

As an aside, even before July 1, 2010 payday lenders had to be registered with the state and had limits on interest and roll-overs so even loans made before then should be check out to see if they are legit or not. I had a couple that predated the law, but were still from illegal lenders as they were not registered and were not follow the limits set forth by AZ law.

Fortunately for me the language I had in my letter worked as I did not receive any phone calls at home or at work and my references were never contacted. Now, I have received the scam phone calls you may have read about from the Department of Law and Investigation claiming they are collecting on behalf of an unpaid payday loan, but those don't erally count. Also, since you are currently dealing with the original creditor and not a collection agency, the rules are a little different.

This was sent before and never responded to. I then sent a follow up that was not responded to. Today you harassed me at work (which I specifically asked you never to call again) and you are ignoring my request for the refund amount specified and outlined below.
You are running an illegal operation and further harassment on your behalf will be noted and reported to the FTC and my Attorney General. I have already filed a complaint with the AG and I am now ready to take it up to the federal level.
I suggest you respond via email with what your action will be within the next 24 hours or I will consider our transaction VOID and NULL and should I proceed to go after the overpayment I have made I will make the necessary collection calls at that time.
By failing to respond to this email within 24 hours you acknowledge my position and my account will be closed in a positive standing and no negative reporting will be held against my name and ssn#.
