Allen Lewis not sending the agreement in writing

I have a payment arrangement made with Allen Lewis & Associates on a pastdue account and had requested that they put in writing the arrangment that was made and mail to me before I send them any money. I contacted them today since I still haven't received anything in writing and they are stating that they do not mail out arrangements. This does not seem right, are they not legally supposed to send me documentation outlining a payment arrangement if I requested it?


There is no legal requirement for payment arrangements to be put in writing. But, you need to get it in writing so that you have a written proof of the arrangement. Cover your base and make your side stronger by sending a letter explaining the proposal. Request them to acknowledge it in writing before anything is paid. You will have your side of the story clearly explained. Send your letters through certified mail with return receipt requested. Keep copies documented in a file for records.

I received a message on Saturday, before 8am central time on my home phone and work phone. I returned the call today. I had already spoke to John Jameson in November about a debt that I owe. He wanted to review my account and then begin telling me that I had told him I would be able to settle this debt sometime around Feb. 06 when I got my tax return back. Number one, I never said that. He also said that I would be willing to pay this amount. He said they don't take payments by mail, only quick collect and check by phone. I told him that I never even received a bill from them to begin and that my husband would not ever pay anything to anyone without a statement/bill of some sort. He informed me that their collections department had sent me a document before. He called out my PO Box and I told him that we never received it. He informed me that he was from processing and that he did not have to send me anything. I told him we were not getting any tax money back and would probably owe taxes. He replied with, "oh well and now who's fault is that?" He was so hateful, arrogant, rude, and disrespectful. Finally he told me that he would mark us down as refusal to pay and it would be written off and then placed on our credit.
I called back and asked to speak to someone in management or a supervisor. They gave the call to a man by the name of Tony Davis. I tried to explain to him how John Jameson had talked to me. He said, well now if you had paid the bill then he wouldn't be calling you. I told him that JOhn Jameson had called my house before 8am on Saturday and he informed me that it was almost 9am. I told him I was in central time zone. He said that didn't matter. Tony Davis proceeded to tell me that if I was not irresponsible and did not try to rip on these creditors then i would not be in this mess. He said so many cruel and mean things to me. I was almost like he had a paragraph in front of him and was reading it. Then he asked me, now do you get the big picture. He basically talked to me like I was a yard dog.
What can I do about this. I will not send money to anyone who talks to me and operates in this manner. Who can I report this to, so that they can be investigated? Thank you!
