I live in Mississippi and had taken out several online payday loans. They were all set up to be renewed each pay period unless I arranged to pay them in full. I wish I could have. I did have several payments deducted from my checking account but since have defaulted due to my husbands loss of income. I have looked up the laws for my state and as far as the legal part, it says "State Legal Status
Lending of payday loan is considered legal (applicable for check cashers only) in the State of MississippI.

It also says,
Permissible number of Rollovers - None (cannot be repaid or otherwise extended)

Where do I legally stand with these people? I have already talked with the Dept of Banking and Consumer Finance. I was told that the ones I have are not legal to loan in my state. If I e-signed finance agreements with them, are they still inforceable? Help.

If these companies are not legal in your state, then you only need to pay the principal amount. You don't need to pay interest or other fees. You can get useful information from the pages given below:

I am having the worst time with Star Cash Processing. They keep telling me that it doesn't matter what the laws in my state are because I e-signed a contract with them. I borrowed $300 + the $90 fee and I can account for having paid them $300 so far. Still trying to find one of the bank statements. I just finished a call with them where the lady said that I was refusing to pay the $480 that they say I owe and that I was rude to her. I told her to quit calling me at work and she just said that they would continue collections. Should I talk to a lawyer?

First of all she is wrong. You are bound by your State laws. Have you sent them the cease and desist letter. If not, do that. You can find a sample on this forum. If Star Cash Processing is not licensed to do business in your State, then you are only obligated to pay back the principal balance which it sounds like you have already done.

No. I have not done that yet. Do they have to be sent by mail or can I fax and email to them?

well check your statements because since star is illegal any debits go towards the loan example:

you borrowed 300.00.they take three debits of 90.00. you only owe 30.00.see how it works.an illegal lender is only entitled to the principle and any supposed "fee debits"go towards the loan so to summarize if they debited 300.00 or more you truly owe nothing to this illegal pdl.

I just emailed them telling them to stop calling me at work. I also included again all of the info about the laws and talking to Atty Gen's office and the Dept of Banking and Consumer Finance office about them. I got a letter from CMG that they want me to get notarized and fax back and they say they will mark my account as paid in full. Doing that today. By the way, where the heck of Charlestown, Nevis? That is the address on the top of the letter.

wait a minute.what did the letter contain?read it carefully as i have never heard of them doing this at all.if it does look okay do not fax it from your work as i think they just want your work fax to send a WAGE ASSIGNMENT.again read it carefully, and then if it does look okay fax it from another location, and not your work fax.
