My "Get Out Of Payday Loan Hell" Plan
Date: Sun, 02/13/2011 - 13:11
OK, here's my situation. I was laid off last month and am now collecting unemployment. Job aren't lining up as of yet and I cannot afford to give these payday companies my money.
Here are the payday loans I have and I'm in Idaho:
CashNetUSA: $1000 (have paid $350) in interest to extend the loan.
Cash Central: $600 (have paid $135 to extend loan).
First Bank of Delaware installment loan (original loan was $1000...and have paid it down to $735).
I called FIrst Bank of Delaware...and they stopped ACH and sent my acct to collections. They have called me a couple times...that's it. Nothing I cannot handle but at least they are no longer withdrawing from my account.
CashNetUSA was less sympathetic...they said they can put me on a 5-payment plan. I didn't specifically ask them to stop withdrawing....but I cannot afford this.
I have not contacted CashCentral and told them of my situation because I figured they would tell me the same thing.
So after reading the thread on things to do before closing my account, I went ahead and opened a bank account with Bank of America. My current bank is with Chase. With Cash Central due the 15th ($135 extension) and CashNet USA on the 21st ($175 extension) I need to stop this ASAP. Guess I thought I would get a job by now and can pay these things off legitimately, but I don't think that's going to happen because nothing is panning out on the job front.
So here is my plan:
1) send certified letters to CashNet and Cash Central telling them to stop withdrawing from my account.
2) Go into Chase and get them to either close the account (with letters in hand), or open another account that is not connected. If they do not do that, at least I can tell them to close the account permenantly and I have the BOA checking account as backup.
Regarding the outstanding debts, these people can take me to collections, sue me, or whatever. I live in an apartment, have no assets, and am one payment away from getting my car repossessed. So I have no assets they can come after. I just need to take care of myself, make sure i have a roof over my head, etc. until a job comes along. But for now I need to stop these people from taking my unemployment deposit out of my checking account.
one last question.
if I do switch my stuff to BOA and leave Chase. Is there a way they can find out about my other checking account and start withdrawing. Like through my SS number or something? I know that sounds crazy but I read somewhere that was done before. Just curious.
Thank you for reading this...and any advice you can give...(or anything else I might be missing here).
Steve

I would simply close my new account, send a letter to all the lender and tell them due to unforeseen circumstances you are unable to meet the payment schedule, but intend on paying them what is affordable at this time. I wouldn't be too wordy.
I don't think Cash Central is legal in your state, or anywhere for that matter, especially if they are the ones located overseas. Only one way to find out, look closer at their website. You only pay an illegal lender the principal amount you borrowed, less any payments you have already made, they aren't entitled to interest and fees and shouldn't be rewarded with any.
Cashnetusa will probably turn you over to a bottom feeder collection agency, they will threaten and harass the crap out of you, so be prepared to deal with them,
