I received a phone call today from someone who said they were an attorney. They said that we took out a payday loan and never paid it back and now we are going to be "served" to appear in court and her personal investigators will be at our door on Wednesday. HOWEVER, we have not taken any payday loans. She was talking very fast and was very argumentative. She said they represented Instacash??? She had all my husband's personal information - ss#, place of employment, and bank name. I have no idea what she is talking about and she was very vague. I am worried that this is a scam or that someone has gotten our information and committed a fraud. We NEVER received any payday loans!!! Any experience with this. Any recommendations on what I should do?

It can be scam call trying to take out money from you and your husband. The next time when you receive the same call, ask them to validate the debt. You can even send them a debt validation letter in this regard. If you haven't taken out a payday loan, then they won't be able to validate the debt. Thus, you won't be liable to pay anything to them.

well i wouldn't hold my breath waiting for anyone to come to your door as this smacks of total scam.this place could have gotten your info in so many ways.here is what you do.next time this woman calls demand something in writing and state you will not talk to her until you receive it.then use any numbers you have to file a police report as she broke the law with her call.then put an alert on your husband's account.btw instacash is an illegal internet pdl so even if you did get a loan it would be illegal anyway.just know most likely she,or somebody else will call today or tomorrow.demand something in writing then hang up file the report then ignore them.
