This company calls and writes on behalf of fingerhut. I filed bankruptcy in 1999 and they were included. It was discharged. I sent them copies of this as well as my credit report, but they keep calling. What is my next step?


Hi aem, if I were in your shoes, I would put all of this in writing to mcm, explaining that is was discharged through your bankruptcy...even send a copy of proof if you have it. And also include a cease and desist clause in it telling them to no longer call you about this account. This should stop the phone calls with bothering you about an account that has already been taken care of. But it must be put in writing to them. This is pretty 'cut and dry' to me, as long as you have the proper paper work showing that this account with included with your bankruptcy. hope I have helped, shirley :D

Aem, besides sending a cease and desist letter, you might like to record the phone calls of these debt collector for getting a legal proof against them. Check the state laws before you attach a recording device. 35 states allow the recording secretly whereas in the remaining 15 states, you will have to take the permission from the other party. This recording will add strength towards your legal actions against the CAs.

They keep calling me about a "debt" that I allegedly owe to a telephone company in Tennessee, the problem is, in 2002 when I was supposedly racking up this debt, I was in TEXAS! I have proof of this and have told them this many times, but they continue to harass me.

telling them and showing them are two different things. to play the devil's advocate, imagine how many people a day tell them the same thing? show them the proverbial pudding. i would also look into SOL issues on this debt and consider a cease and desist depending on that first.
