I cannot keep up with my credit card debt. Capitol One has turned theirs over to a collection agency. They are threatning to go to court. What can they do if I cannot afford to pay?

If you can't pay off your debts, then the collection agency can file a lawsuit against you. If they win the case and secure the judgment order, then they can even garnish your wages and savings accounts. Your credit score will also get hurt. So, I would advice you to settle your debts with the collection agency asap.

Capitol One is hard to deal with. I would suggest that you try to enter into an agreement to pay something. I was able to negotiate 2 payments to catch my account up, and then pay the minimum until paid off. There was no settling with Cap One.
