How do I remove the wrong information reported by LVNV from my credit?

Glad I came upon this site!
I have a Home Depot debt on my DR which went into collection back in 2001. To make a long story short, there has been no activity on my part or my ex-spouse's part since 2001. Yet this account, which is now owned by LVNV, shows an estimated date of removal in 2012 (TransUnion credit report). I have not contacted this company to assume the debt nor have I signed any note. I have three questions.

1.Why might the collection company have done this?
2.When does the 7 year clock start running on delinquent accounts- Is it the last time a payment was made on the sccount or the very first time a payment is late?
3. Should I contact the credit reporting agency or the creditor first?

Any info you can give me will be appreciated.

My mother received a letter from the Court that she is being sued by LVNV regarding an old sears account. I am not sure what she should do, she has no money, no job and does not own anything at all... what could they possibly take from her. I am reading all the comments and most of them say she should request a validation of credit letter.. is there some kind of format I need to follow? We are in the state of texas, and the accound says it was open on 6/2003, but that sears account is way much older than that. Is the date open the day the account was taken over by LVNV? I am very confused and extremely angry, I never thought credit people would do this?????

Nohelia, ask the company to give you the complete information about this account. Send a debt validation letter and LVNV Funding must validate the debt in writing. Send your letter through certified mail with return receipt requested. You can show the green copy to the judge. If LVNV Funding does not validate your debt, this green copy will be your important evidence about the company's failure in giving out the details. Use this letter as per your requirements.

I also saw an LVNV item on my creidt bureau for 98$ but it doesn't show the original creditor or LVNV's contact information. I haven't had anyone call me to try to collect 98$ as if they did I would've probably paid it as have it appear on my credit bureau. I have another question as well. When I was divorced in 98 we had some cards that were split. I've paid my half, but my ex hasn't paid hers. I know legally the c/c company can keep us both on the credit bureau until the debt is paid, but it went into default in 99 which is about 7 years coming. One was for 1442.00 and the original creditor was Providian. That appears and then there are two others that are collection agencies that I've never spoken with that have origination dates in 04 and 05. Can collection agencies start the process over again and thus extending the 7 year time span? What can I do to remove them if they are doing this illegally.

The first thing I would do is,make sure these are not out of the SOL period for your state. If they aren't,send them a debt validation letter,certified,return receipt.Here are the address they use http://forums.debtcc.com/lvnvfundingllc/index.html .If you make a payment anytime before the SOL period is up,they will re age the account,and the SOL clock starts all over.Good Luck-Keep us posted :D ...Karen

I saw an LVNV item on my creidt bureau for $645 but it doesn't show the original creditor or LVNV's contact information. I haven't had anyone call me to try to collect $645.00, if they did I would've probably paid it then to avoid having it appear on my credit bureau. I have another question as well. I know legally the c/c company can keep me on the credit bureau until the debt is paid. So I am requesting contact information regarding this account that I may rectify this debt. What can I do to remove this item from my credit file or at least show a zero balance. pls email me at email address removed as per forum rules - Mike with the necessary information need to resolve this issue.

Marilyn-the address for LVNV is in the post above yours. I would send them a debt validation letter so you will know who the oc was,and also to make sure they are legally supposed to be trying to collect from you.You also need to make sure that this debt is not out of the SOL period. If you don't receive a debt validation from LVNV(and you probably won't),then you can dispute with credit bureau,and also if it is out of the sol period,dispute. You said you wanted it reported as paid,did you pay this debt already? If you have,contact the cra and dispute with the proof you paid. Hope I haven't confused you! Good Luck...Karen

Please reply to me as to what the charges are that are owed. The invitation code given was 02012****. As far as I am concerned there are no monies owed. I need to know the status and if I must contact my lawyer to contest this. I expect a speedy response.

Sharon- Are you trying to contact LVNV Funding, or another company? This is a debt related forum where others post about their debt problems and ask for solutions. If you do not owe them anything, send them a debt validation letter to prove it's your debt. They won't respond, probably, but you will have proof you are trying to get it straightened out. I dont understand, I am trying to contact these folks & it seems as they fell off the edge of the earth... (no response). It stating that I owe them money dating back to 2001. I don't remember anything being open by me. I was in GERMANY and never tend to open anything... Until I got back to the states in 2003. So help... What can I do to get these folks off my credit report...

I received a letter from my local court notifying me of a judgement filed against me for not appearing in court on behalf of LVNV. I had know prior knowledge of a court appearance. LVNV purchase this charged-off account, and are current listed on my credit report along with the original owner of the account. Can LVNV legally place a judgement on my public record when there is a negative listing presently on the credit record? The account is schedule drop-off over the next couple of years, but will the clock reset due to the additional judgement.

Any clarification as to how I can address my concerns and resolve this problem.

PS---My situation is very similiar to Suze's experience.

I AM BEING SUED BY LVNV. MY SITUATION IS THE SAME AS NOHELIAS MOTHER. WHAT IS THE FIRST STEP I SHOULD DO? DO I SEND THE debt validation LETER TO LVNV? OR DO I SEND THE LETTER TO THE COURT CLERK AS STATED ON THE CITATION THAT I RECIEVED BY THE CONSTABLE? AND WHAT AM I SUPPOSE TO WRITE TO THE COURT CLERK? Welcome to the forum Yvonne.
First you need to answer the civil complaint (I don't have a lot of experience with those, someone with more experience will be along to help you) sending out a validation letter at this point would be moot, however what you could do is request validation during discovery. If they cannot produce simply motion to dismiss with prejudice.

I also have a few questions about this debt.

1. What type of debt is it?
2. When was the last time a payment was made on it?
3. What state do you live in?

21 years ago , i was a freshmen in college and bought a dinosaur computer for $999 dollars...my recollection is that i paid it ....its not in my credit report.....How do i file a response to the court in legal response???? help???

First you could contact the original creditor to request information on the account in question. To further assist you could you please answer these questions:

1. When was the last time you made a payment on it?
2. Was it a secured loan (using the computer as collateral)
3. What state do you live in?

I would suggest sending them a debt validation letter (you can find a template via the link in my signature) send it certified mail, return receipt requested. LVNV has a rather shady track record and as such I would suggest not doing anything until they can validate it. On behalf of someone I contacted ARS regarding settling an account. They agreed to settle at 45% of balance. I received a fax stating such but noticed that this account was purchased by lvnv funding llc. Does this mean that if I pay ARS that there could still be outstanding debt for the same account to LVNV? The original debtor was Sears as indicated on the letter.

Is this true? I found their name on my credit report but I have no idea what it would be for...I always pay my credit card on time. Should I not follow up with the company because of the statute of limitations like this poster says? How else can I find out what this debt is in reference to? Will it really not help my debt to pay what they say I owe?

Hi, i have just received a letter from the clerk of circuit court asking me to appear in court against LVNV Funding L L C. I have moved several times and the letter was sent to my old address and therefore the court is not in the same city in which i reside in now.

I went throught a period where all my cc account went delinquent. Therefore, I have not kept up with who purchased my debt. in the letter, it only listed the name LVNV Funding L L C. There was no contact number or the amount I owe.

What is the first step i should do? Should i try calling them? but i don't even know the account number? i do not want to drive 3 hours to have to appear in court at the rate of gas....in the court letter, it says i can write them with a good cause that may result in dismissal. have anyone ever tried that????

To start off with, what state do you live in now?
When was the last time you paid on the debt?
Who is the Attorney for LVNV Funding? Should be on the court papers.

You will need to get a copy of your most recent credit report to see what information is on there. Every state has laws they need to follow so depending where you live you may have a easier time taking care of this.

Someone will be along shortly and give you a template for a debt validation letter. Also look at the docket number on the summons and call the court house to make sure it is real and not a fake document from a debt collector. Ill be around again tomorrow and will see what else I can do for you. OH YEAH and NEVER, EVER give your personal information over the phone to these debt collectors. Tell them nothing. Don't admit anything either, deny it all at this point. If they say, "your debt" you say "alleged debt"

Check with the court to make sure they have filed against you, if they have then be sure to appear in court on the day of the hearing or the judge will issue a judgement against you. When you go before the judge tell him that you no longer reside in that jurisdiction (improper venue) and ask that the case be dismissed.

thanks for the info. I currently live in Orlando florida but the letter states that i need to appear in a court in Tampa fL. I moved to orlando about 1 year ago.

i requested a free credit report last night and LVNV appears on their but it doesn't look like they have the orignial cc company name.

should i try contancting LVNV? or the courts first? I want to do anything to avoid appearing in court on june 11.

ok, i am really new to this and i haven't gotten muc respose but here goes anothing post....

i called the court to see if that was really a case file against me. I gave the representative my case number and she told me that i didn't have to appear in court. That the letter sent to me was a NOTICE OF INTENT TO DISMISS FOR LACK OF PROSECUTION ON COURT'S OWN MOTION....have anyone ever recieved this letter? what should i do next????is it true that i won't be penalized for not showing? she told me that either way, the case will be dismiss

i ask the representative if there was a lawyer name or number on it and she gave me one. One number was to Morgan and Morgan ( a law firm located here) and the other one i couldn't reach anyone.

Should my next step be that i send LVNV a request for a validation letter???

Today I also found an account from "lvnv funding llc", opened on April 2005 (BTW, I am living in Georgia now, the Statute of Limitations here is 4 years).

There is a line says "Collateral: 12 SEARS CITI SEARS". There is a long story concerning the Sears Card. It is a secondary sears card that I applied in Ohio and lost several years ago and it is used by somebody for $129 and in August 2003 it was charged off at $407, and I did not know all these until Dec 2004. By that time Sears was already sold to CITI, and I failed to explain this to CITI collection people. However, I disputed with credit agency such as Experian and Transuntion and succeeded.

Later, looks like CITI sold debt to LVNV and they began to send me settlement letters and I ignored them, thought I did nothing wrong. No letters coming from LVNV anymore ever since 2008, though. But when I check my credit report today, LVNV are listed on all three credit reports, and my credit score is really low

I have the following questions:

1. Since it is a credit card, should SOL apply to April 2005, or August 2003?
2. SOL should be 6 years (Ohio, as where it was applied) or 4 years (GA, as my current residency)?
3. Am I still in SOL? Or Out of SOL?
4. If I am within SOL, should I write DV to LVNV now, right?
5. If I am out of SOL, should I dispute with 3 credit agencies?

Appreciate the help!

To answer your questions:
1. SOL should apply to the date of last activity(when you last paid on the account) since apparently nobody has paid on the account it would run from the date of last debit.
2. SOL would run for the state which you currently reside in therefore it would be 4 years as you stated for an open account.

3. That means that the SOL has expired.

4. Yes, you should DV them as well as Sherman Acquisitions and Resurgent Capital Services to make sure you have all their companies covered.

5. Yes, SOL is just the time frame in which they could bring civil action against you. The time in which they can report to a credit reporting agency (such as experian) is governed by the FCRA (Fair Credit Reporting Act) which is 7 years plus 180 days from the DOLA (date of last activity)

I hope I have answered all your questions to some satisfaction. If you need a DV template you can find one via my signature link, be sure to send it certified mail, return receipt requested. Also be sure to send the enclosure with it.

Yes, I will DV all of them (LVNV, Resurgent Capital Services, and Capital Management Services) with certified mail. There are several following up questions:

1. Is it too late to DV them. They did mail me last July but I did not argue with them, so 10 months past already.
2. What can be the possible or best solution after that? Pay them? Or dispute?
3. If pay them, is it safe to pay them after SOL? Will this clean my credit record? And how much should I pay, the amount they purchased the debt or the original debt ($129)+fines ($524)?
4. If dispute, dispute with whom? LVNV, or credit agencies? (I believe the original purchase did not bear my signature because it is lost/stolen)
5. I know after SOL, I am not obligated to pay them. But since they can continue to report to credit reporting agency for another 2.5 years and will keep hurting my credit score, what can be a solution to protect my credit against them?

I have a Sears bill for windows that I bought. When I was making a lot of overtime. Then of course I get laid off. I was paying one collection agency monthly then after a month the collection agency didn't have my file. So then about three years have passed then I get a letter from the Sheriff coming to the door with a complaint from LVNV (Mann-Bracken) So I saw a lawyer he told me how to respond to the complaint. Just had to answer the twelve questions they had . I went to the dept.of Prothonotary & filed my response I get another complaint today but not from the sheriff saying I'm being sued for not responding. At one time we made them a settlement offer they said they would get back to us. When we call there we get an Indian that doesn't speak english. There machines would call us tells us to call back and we get this Indian guy again. I can;t understand why they said I never responded to the complaint. I'm looking right at it. It is stamped and dated @ the court house. Man are these people scum are what.

You Should not have to prove the debt is not yours. Put the burden of proof on the plaintiff. Motion to request production of documents. you can go to the court house and find out how to do this or your local law library.

Also check all 3 of your credit reports and see if LVNV funding is on there, then look to see if the original creditor they say you owe is on there also. If not then that is your proof right there to show the judge.

Still fight it though, request production of documents.

What state are you in? are you positive this is not your debt?

please, someone help me if you can, i and my husband purchashed 2 vehicles in 2003 one for me and one for my husband paid mine off, but my husband,s job had to cut some of his work days short, and i am on ssi disability with a small income he couldn't no longer make payments so we didn't have no choice but to turn the vehicle back in. to a co. call citifinancial. that was 3 years ago. a man came to my door a month ago ,served me with a summons to appear in court for a credit card debt, i never had a credit card in my life. when i went before the judge i disputed it. so the judge gave me another court date set for feb. 3rd 2009. he asked me to bring proof that i don't owe that debt. please tell me what i can do. i never recieved a bill from this co. LVNV never heard of them before.

After recently receiving a collections notice from Capt Mgmt for a debt claim from a closed Discover card acct from 2000, I checked my credit report. The report shows no sign of outstanding debt or delinquency.

Do I need to respond to this claim?

Will they stop contacting me at some point?

recieved a letter regarding account that was known closed. the phone number is only for fishing. there is never anyone to get ahold of. put in a complaint with better business bureau. don't contact them with any information!

Went to the bank today to take out a loan - I need to clear up a $61 balance with them before the bank will issue the loan. Under "date open" on my report it says "11-2008" and "date reviewed" as 03-2009". I have NO clue what this LVNV Funding balance is for, but I have to get this cleared up fast as I already have a down payment and a purchase order in for a new RV. Should I just pay the $61 or will this potentially invite other problems? I have read on some forums where people say it will.

HELP!!
