Glad I came upon this site!
I have a Home Depot debt on my DR which went into collection back in 2001. To make a long story short, there has been no activity on my part or my ex-spouse's part since 2001. Yet this account, which is now owned by LVNV, shows an estimated date of removal in 2012 (TransUnion credit report). I have not contacted this company to assume the debt nor have I signed any note. I have three questions.

1.Why might the collection company have done this?
2.When does the 7 year clock start running on delinquent accounts- Is it the last time a payment was made on the sccount or the very first time a payment is late?
3. Should I contact the credit reporting agency or the creditor first?

Any info you can give me will be appreciated.

Thanks.

summons to court 30 days to answer answered did not live in that county . So there was a request for change of venue in court in front of Judge should I call now before the new paper work is served and ask for a chance to offer to work out before court

I pulled my credit in June of 05 from all 3 CRA's and luckily Equifax reported the date of last activity on Dec 1999 with MCI / which was showing up last month as LVNV Funding. I disputed it with Equifax as being over 7 years old and they actually took it off pretty fast and emailed me validation. However, I still need to dispute LVNV with Trans and Experian. Only problem is my old credit report from June 05 with those do not show my last date of activity. Is it required when one CRA deletes something the others have to follow? Any advice?

Listen LVNV Funding is a collection agency, from my own experience you need to first send a validation letter certified mail; then contact the Attorney General in your State. LVNV Funding will NOT validate a debt properly. Do not call them an be very agressive with what you want. If they are doing business improper then they will slip up. Write letter after letter requesting all everything you want. Make sure if you get another collection company whether it says it from an attorney or not you read the fine print.

Listen EVERYONE THAT HAS ASKED ABOUT LVNV FUNDING. There is an attorney by the name of Larry P Smith and Associates. Call them immediately, their information can be found on line. I do not work for them or have any agreement with them. I had excellent service from them and the results were outstanding. LARRY P SMITH

Before settling anything always keep track of who you spoke to the date and info discussed. If you plan on settling a debt always keep in mind the collection agency has purchased your account for less than what you owe. So never pay full amount. You account may have been sold 2 or 3 times in which case your account was sold each time for less than what the other companies have paid. Send all letters certified mail to have proof of any attempts on your part to resolve the matter. Save all receipts from Post Office. And send payment by Cashiers check (not from your bank) never tell them your bank establishment. On your cashiers check write at the bottom "cashing of this check constitutes "payment of full" or payment settled. Also send confirmation letters of all conversations with any agreement that was made verbally by phone. Remember they wil most likely take something rather than nothing. For those of you that are going to file bankruptcy make sure you include all credit card companies.
