I had an acct w/sears many years ago and we had payment problems due to economic down turn...we did set up payment plan which I have record of...we made identical payments over a period of a few months ..every two weeks, documented by bank auto withdrawl to cover the entire amount left on our card. After this time there should have been no balance left and after a period of time we got bills for late fee...we called and each time someone said it would be taken care of, it was never taken care of and now we are sitting with a $318 account that has been sold to LVNV Funding....any suggestions


You have documents mentioning the settlement plan with the creditor. You should contact the original creditor and try to sort out the matter with them asap. You can send them a copy of the settlement plan and ask them to withdraw the account from collections as you've already paid them off. You can even contact an attorney and take his help in sorting out the matter and dealing with your creditor.
