Did your mom do the check or you? I wasn't quite clear on that. Unfortunately a check over the phone is still a check, but it depends on the wording of your state law and how they handle electronic checks....but generally this was a check given to them and it didn't clear...depending on the state they could send the account to the district attorney and if it isn't paid then yes, whoever wrote the check could possibly go to jail....as I said, depends on the laws of your state. BUT even with the harshest laws, you can't go to jail if you pay the bad check plus the bad check fee....most states say that the creditor has to give you the chance to pay it before they can submit to the DA....for example in Texas they have to send you a certified letter explaining that if you do not pay the check and fee by a certain date, they will turn it over to the DA for prosecution. And even if they do that, the DA gives you time to pay the check, the fee and an added fee from the DA office itself.
As for the pdl collectors that is a whole different ballgame...depends on a wide range of factors such as if the PDL was legal in the first place. You should DV the collectors and go from there.
