On February 9 of this year I received a phone call from this company. I did not acknowledge the debt was mine. They wanted the last 4 of my husbands social security number and I did not give it to them. I have been waiting ever since for them to send something in writing but have not received anything. They call all the time and I do not answer the phone. I would like to send them a dv letter but I need an account number. What should I do? :confused:


Go ahead and give them the last 4 digits of the social as well as confirm your mailing address and then ask for the account number and their mailing address. Also inform them they have 5 days to send you a dunning letter.

Wait the 5 days. If you get nothing then send the DV along with mention that they have already violated your rights by not sending written communication as required by law.

Ok I called them! The person I spoke with was quite rude. I said ok if I give you the last 4 of the social will you give me the account number. She said yes so I told her. Then she was trying to get all other kinds of info from me. She told me I needed to calm down and that our conversation was being recorded. I said that is fine with me. I said in fact after your first initial contact with me you should have sent me a dunning letter within 5 days and I have received absolutely nothing. She said oh we sent that out on 2/09/11. I said well I have never received anything and I have been anxiously awaiting a response from you through the mail so I could get an account number for this matter. She said well we cant help it that you didnt get it! Then she proceeds to try and get me to pay for this debt and asked me for my name. HELLO???? I already told you my name! I said no I am done I will be sending you something through the mail and I hung up. It wasnt five minutes later and they called me back but I did not answer the phone. They did not leave a message.

At least you got the info you needed, now you can send them a debt validation letter. Perhaps they did something, just didn't have your correct mailing address, one reason why I suggested to confirm your mailing address......if they have the correct addy they will hide behind the 'we sent you a letter' and unfortunately, if they show they have a process for sending out collection letters, you likely won't get them on the 5 day thing.....BUT you can still threaten them with it, at least it shows you know your rights and they may proceed more cautiously....many CAs (the disreputable ones) don't want to deal with people who know their rights.
