i live in El Paso, Texas and got a car title loan in Sunland Park, New Mexico. I got a loan for 300 dollars i have been paying it for a long time and hadn't even brought my balance down. Until one day i got in a car accident, the car was totaled and i went disabled for 6 months. I stopped making the loan payments. I called them to let them know of my situation and they kept telling me they would call back and they never did. I didnt even get any letters in the mail regarding my late payments. Today i had one of the loan employees come to my home at night banging on the door so hard and loud i thought they were going to break my door that i opened it and i started getting yelled at by a man telling me that if i didnt pay back the loan or give some kind of payment they would send cops and take me directly to jail. I tried to explain my situation and that i had already called them but i kept getting cut off and the man yelled i was going to jail because i was stealing and that since i got the loan in new mexico i could get sent to jail for not paying a loan back. Is this true? what can i do?


If the lender dues not receive his payments on time, then he can take legal actions against you. However, you will have to somehow negotiate with your creditor so that he understands your situations and offers you some kind of help to pay off the debt. You can even take the help of an attorney in this matter as the representative of the lender has spoken about legal actions.

For starters you cannot go to jail. Secondly I would have called the police on this person for breaching the peace.

Their collateral on the loan is gone. The loan is now unsecured. you live in texas...they cannot garnish your wages.

I would suggest calling your state AGs office and filing a complaint.
