I have been reading the posts on this forum and decided to send letters to the PDL's instructing them to stop ACH debits. The part I'm not sure of is the overpayment of previous fees, what I actually have to pay, etc for LA.

I have had several previous loans and have overpaid fees requried by LA. Has anyone ever received the over paid fees back? I thought about giving them options in the letter.
For example: I have about 200 in principal left on one loan to a licenced lender outside of LA. Lets say from previous loans I have overpaid in fees according to LA law by $1000. Can I request that they refund the the overpaid fees? Can I state that given the overpayment the $200 should be considered paid in full and they acutally owe me $800 or say that I will pay the $200 principal only?

Would this work for unlicensed lenders as well?

Thanks in advance for any help or assitance you can provide. I can't wait to be out of this mess!

Oneclick cash-Current loan is 400. 1st due date is 3/25.
Cashcentral-Current loan is 300. Have paid about 210 in fees, none towards principal.
Mynextpaycheck -Current loan is 250. 1st due date is 325.
Cashnetusa-Current loan is 225.

I have had multiple previous loans with the above and have paid the excessive fees. I know cashnetusa follows LA payday laws.

First thing you need to cose your bank account. I cosed my account simutaneousy with sending the letter. After I sent the letter they still tried debiting my account. I use a credit union and explained the situation to them. They said I needed documentation to support that I notified the lenders to stop the ACH. Which was the revoication notice. I send the notice in the midde of the night and had the credit union close the acccount in the morning. Previous to that the lenders were "phishing" in the account. SO this hepled because the CU did not charge for those return fees.
I had loans with one click and my next pay check and over paid . They do not respond to the letters and call you. I have filed complaints with the BBB, FTC and AG. Neither of them responded to the BBB complaint. I heard nothing from the FTC. The AG in Fla basicaly said sorry for my problem but they will take note. So I am plaaning on filing with the State Finance. I am going to do that in Fla and also OK. One Click has a OK address and they do not comply with the laws of OK or Fla.

According to LA laws if they attempt to withdraw and get account closed or anything other than "insufficient funds" they can come after you for the debt. They have three letters/opinions posted on their website pertaining to this. That is why I am scared to close it.

Are one click and mynextpaycheck still coming after you for the debt?
