Unique Bank Account Garnishment

Okay so I have a unique account garnishment situation that I really need help getting solved. On Friday February 11, 2011 a garnishment was taken out of my account in the amount of $100.00 and my accounts were thereafter frozen (I am a college student away from home and had money in my savings for living expenses and ICE). I called my bank and was directed to their legal department and wasn't able to get any meaningful information (I wasn't able to get in contact with the rep over the case). I did however, manage to get the number to the debt collection "law firm" Hayt, Hayt, and Landau, and wasn't able to get any information from them either (not in their database). My mother is a joint owner on my account and I came to find out that this is one of her old debts (she doesn't keep money in this account, so they took it out of mine). I've been doing a lot of research on this since it happened and I was able to find out that the debt collector may be liable for up to $1000 in statutory damages, plus actual damages (and there are actual damages! Teary, frustrated damages), plus attorneys fees for illegal account garnishment. I also found out that I can sue my bank (I believe, but not completely sure) for taking the funds out because I am not my mother's spouse and I do not have any outstanding debts or any in collections (I pay my bills rather religiously and have made it a point to not be late). I've tried to get in contact with consumer attorneys about what to do but have not received a reply. I really need help resolving this situation as this is putting hurting me BADLY and I need my accounts unfrozen and my money returned to me (and maybe additional compensation for the stress and extreme financial burden this has placed on me) so I can move on from this and get my monies back in order. I live in Florida as well. Help is very appreciated.


Where in Florida do you live? I live Orlando. Honestly, other than legal aid or hiring a lawyer yourself thats about all you can do. I know here on Orlando the Law firm of Morgan and Morgan hates collection agencies and has sued some of them. Give them a call at least for a free consult, I also do believe they have many offices in Florida. Check the yellow pages for lawyers with free consults and that work in debt collections(on the side of the debtor)

I live in Tallahassee. This "law firm" collection agency, Hayt, Hayt, and Landau is actually centered in Orlando (they have a TON of complaints filed against them for unfair debt collection practices, etc., and they seem kind of shady). I wonder if I could still seek help from the attorneys you mentioned, even though I don't live in Orlando. I have gotten in contact with a consumer law attorney and I'm waiting to hear back from them. I'm really frustrated with this whole situation as it has nothing to do with me and I'm being financially penalized for a debt that isn't mine.
