Just received a summons from WWR and its all lies lies lies.

They listed the bank as the plaintiff, and they suing my company, (which I am not personally liable for any debt of the company)

They attached a "verification of complaint" which basically reads like an affidavit, all lies, about how this so and so person has personal knowledge of record keeping, lies lies lies.

I think they included the verification of complaint, because they needed something tying them to the OC, since they are NOT the OC.

My point is, the verification is all hearsay.

Do I treat the verification the same way as a affidavit? The verification of complaint, was not notarized btw. Usually affidavits have to be notarized.

I am thinking if I can strike the verification of complaint, then there is no case. There is nothing tying them to the OC. The list the OC as the plaintiff, and how they are attornies for the plaintiff, but in reality they are JCBs and have no authority to sue.

I am IL, which is considered a state, where you can demand proper verification of a complaint, or else the case gets thrown out.

I am confused, because usually this verification of complaint is used by defendants, and not plaintiffs.

Its usually used by defendants when there is a question of jurisdication, like in a traffic ticket. The defendent will file a motion of verificaiton for complaint, and if the other side does not comply, then is case dismissed, since a citation is not enough to bring a formal complaint. You have to request a formal complaint.

I understand why they are using the verification of complaint, its the only thing that links them to OC, (they claim that they are a servicing corporation successor to the original credit, which in and of itself, constitutes hearsay. )

I just hope I looking at this right.

WWR, they are falsifying documents and lying. They cut and pasted the credit card agreement, and did a real sloppy job.

I feel like they are rapists, that raped me, and now they are taking ME to court for the raping!!!!!! UGH!
