Hey Nelly, My friend used her sons (with his permission) credit card a couple of years ago, he never gave her payment info for her to take care of it. His name is on the card, but he has Allied calling her and they told her that they were prosecuting her for faliure to pay. Can they even do this on a debt that has her name no where on it?


No, they can't. Unless her son has filed charges against her for fraud and claims she used his card without permission; and then it wouldn't be the collection agency suing, it would likely be the state. If her name is nowhere on the account, they have no right to be calling her. She should send them a cease and desist. She should also talk to her son about paying off what she charged on his account so he's not getting harassed for her charges, permissible or not.
