Collection Agency and Car Repossession

My auto loan was charged off with a balance of $1452.00. I still have the vehicle. The loan was sent to a collection agency Ocwen/Nationwide Credit. I contacted them to make arrangements to pay off the balance. We arranged 2 payments of $726. The first payment was drafted without incident. All of the funds weren't going to be available on the prearranged date for the second payment so I phoned and asked if we could break that payment into 2 payments. Initially the agent tried to take me thru a guilt trip about why they money wasn't there and said I already agereed to the payment for that date so if they couldn't draft it that day they were going to come pick up the vehicle. I explained that none of what he was saying was going to put extra money in my account so he can either take what I had or do what he needed to. He kept stating that they were going to come pick up the vehicle so I asked him what date so that I would be prepared. He placed me on hold then came back and said I could make the payment for $363 and pay the remaining $363 this week. He said he would "try" to hold it back from the repo agent. I western unioned the $363. And will western union the balance this week. The collection agent called me again and left a voice mail stating that if the balance isn't paid this week they will be looking for my car. I phoned back using the # he left and got Capital One which is the original lender. I spoke with 3 people there who stated that the loan balance was 0 and that they were processing the title to be sent out and that it usually takes about 30 days for me to receive it. I explained that I had been dealing with agent who stated that they were coming to pick up the car. I was sent to their repossessions department and told again that the loan shows paid off and that they hadn't received any notice from the collection agency of anything different. She stated that the person phoning me was NOT from Capital One but a collection company called Ocwen and that they CANNOT repossess my vehicle. She said they would have to turn the account back over to Capital One and they would be the only ones who would have to right to repossess it. She stated again that since they show the balance pif they are processing the title and NOT looking to repossess the vehicle. She told me to ignore his call and wait for my title. :confused: Now my conscience knows I didn't send that last $363 yet. However I am confused as to what has happened here. Why does Capital One show the balance pif. Can the collection agency repossess my car at any time? Please advise.


this is kind of a tuff situation. there are a few things that come to mind. the first thing that comes to mind, if this ocwen/nationwide collection agency did purchase your account from the original creditor then most likely they would have the title and be able to reposess the vehicle. now if capital one maybe just used them as a 3rd party to try and collect on it then i can understand what they are saying. from what i understand with your conversation with Capital one they claim to still have posession of the title. so if that is true then i wouldnt worry about this ocwen agency. now the part about you not sending that last pmt, every company is diffrent so i can only speculate at this point, but i would figure with the account already being charged off, and having such a small balance they probably just considerd it a settlment, at this point its well worth it to them to eat the remaining 300 and somthing dollars to be able to get rid of the account. depending on how long its been charged off. i know some companies when a balance gets down to a certain percent they will just go ahead and close the account and consider it paid in full, but i'm talking 20-30 dollars in those cases, not the 300 and somthing. hope any of this helps or makes sense, there are other questions and facts i would need to know in order to make an educated guess, but if capital one says they are sending you the title i would be a little cautious until you recieve it. but they can tell you what day it was processed and mailed out? that way you can look for it in the mail.
