I'm being sued by PATENAUDE & FELIX on behalf of Target credit card. I have a court date on April 28th. I have called them up many times asking how we can settle this and not have to go to court. Each time I'm told something different. Well that last 2 times I called he said they would settle for $1,475 if I paid up front. I only owe $1,500 and they tacked on fee's making the amount almost $3,000. I told him I only had $1,200 to pay. And that was borrowing money to pay them. He said that he would take that now and then I would have to have the other amount to them by the end of the month. And then he told me that they needed my last 3 months worth of pay stubs too!! Why do they need my pay stubs? I'm afraid of sending them in fear that they will make me pay more. I'm wondering if it would just be better to wait till my court date and deal with a judge on this matter? Any help would be helpful!!


They have asked for your pay stubs in order to check your financial situation. If your financial situation is quite good, then they will ask for full payments. If you're facing financial hardship, then they will consider a better settlement offer for you. It is completely your discretion whether or not you will wait till your court date and deal with the judge.

To me this sounds like they are trying to "strongarm" you into paying back the full amount. With such a small debt amount I suspect they do not even want to take this to court. You have to remember that there are legal fees involved that they would have to pay. It is hard for me to imagine a judge ruling in favor of a judgement on this account, especially since you have been doing everything you possibly can to settle it. My advice to you would be to hire a attorney staffed debt settlement company, who could negotiate with them on your behalf. From my experiences I've found that they are more likely to take the negotiations seriously when you have an attorney on your side.

Seems funny they would go through all that for just $275 difference ($1475-$1200). They're probably counting on you not showing up for court, so they can get a default judgement. Which means you would pay the whole $3000 + fees, etc...

I would go ahead and try to pay the whole thing, and tell them to KMA about the check stubs.
