I received two calls today at work from someone stating that he was calling from county process service letting me know that he had a summons "c-100", and that I have been cited to appear in court. He had an address from another city as to where to deliver it. He asked me to call legal at 1-888-618-6948 to correct the address as he was only responsible to deliver it. He gave me a case number and asked me to call within the next 30 minutes. I called our county clerk office and they have nothing on me. I live in TX. I called the number and I spoke to someone who said that it was a AS Group, a law firm, and he said that I was being sued for "bridge of contract" from First Bank of Delaware on a Continental Finance card for 2k and that I was liable for all additional costs including court and attorney fees if I didn't show up. He knew what I had on my current and previous credit report and said that "he know my type", he was intimidating and asked me to swear to God that I wasn't going to be at work or that I wasn't lying about what I was talking to him about, because I was asking him not to do send anyone to my workplace and that they needed to wait after 5pm to deliver at my home. He said that they had sent several letters and that since I had not paid, this is what they would do. He said that they would garnish my wages and use my car to pay. I ended up telling him to deliver the summons and hung up on him! Can someone advise me on this? I don't want to be sued and I don't want them to contact me at work anymore or show up. What can I do? Can they garnish my wages or take away my car? What happens if I don't go to court? Please help.

If the county clerk is telling that no case has been filed against you, then there is no need to worry. It seems to be a scam. If a case has really been filed against you, then you'll receive court papers. In such a situation, consult a lawyer to deal with the case. The attorney will help you deal with the matter correctly. They can't garnish your wages unless they get judgment order from the court. So, don't be scared. You should continue to go to your office.

i'll expand on that and state that whoever called you broke the law as no "process server"will call ahead.their job is make sure you are served.nothing more.since there is no case(big shock)file a police report as again the person broke the law.then use whatever number you have and file AG,AND FTC complaints.this is a growing scam bottomfeeders are using now.so treat it as such.once you file the report and complaints.ignore them as it is a waste of time as nelly said to worry about a scam,but to close they should be reported.
