HELP - in Illinois!
Date: Tue, 03/29/2011 - 10:25
I've seen some postings on here about contacting these lenders for illegal lending practices, but there is so much information I am kind of confused. Could someone out there sum this process up for me and what the possible ramifications of it would be? I am also married, so our checking account is joint, and I am hoping there is some way to handle this without closing our account.
Any assistance would be much appreciated - I am so ashamed that I've fallen prey to this again!!

Since payday loans are legal in IL, we would need to know the names of the lenders, amounts borrowed and what you've paid back so far.
Your first step would be to close your checking account to safeguard your money from any illegal lenders. Even if some of your loans are legal, your living expenses are the priority. You can negotiate repayment with the legal lenders.
If this is a case where your wife doesn't know about the loans (and I apologize if this isn't so) then you would need to tell her the account must be closed because of "fraud".
The only way you're going to be able to have a paycheck is to close the account. You can read the several stickies at the top of the payday loan forum for more information.

Here is the information I have seen requested from others. And, in this case, it is my husband who is unaware of the extent of this and I was hoping to avoid having to close the checking account. But, if you can advise, I would appreciate it.

In checking IL website for payday loans, it looks like Check'N Go, Cash Net, PayDay One are licensed. IL law only allows two payday loans at one time and provides for a repayment plan. I would contact them to discuss repayment.
You might want to take a look at your loan papers to see where the others are "licensed". It should say somewhere that they are under the laws of the state of _____.
Your state has an excellent website on which you can file a complaint.
Others will be along and can give you additional info.
