I explained that I never wanted to desist and I never said that, that my letter to them was to cease PHONE CALLS only and my letter said written correspondence ONLY. I only wanted to stop the phone calls and no where did I say I wanted all communication to stop. I'm pissed now. Now I'm wondering if this is what is going on with Dell and Wells Fargo. They took my 'do not call' and turned it into a cease and desist. I wonder if this is why I can't get anyone to talk to me at Wells Fargo. I thought as long as you explained that they could WRITE you but you wanted no phone calls, that it was still cool?? I didn't want to stop all communication just the phone calls. I'm worried cause I know that under the cease and desist, they have no other way to communicate with you except to say they're taking you to court, cause you leave them no option. I guess now I have to write wells fargo and 'lift' the C&D, if thats even the problem. I write collection agencies all the time and tell them no phone calls, they still mail me stuff though. and heck, some even continue to call anyways. now what? anyone had this problem before?? thanks, Shirley

The cease & desist letter usually means no more telephone contact period. If you're wanting to open up telephone contact, you will have to fax/mail a letter saying so. However, this also opens up the chance for them to start calling you again.

well, I thought I was covered if I made it clear they were welcome to communicate but through written correspondence only. I only meant and wanted to stop the phone calls, not the other. Now they're trying to use it against me, when thats not what I said. I have never even used the term 'cease and desist' to them. I always add my little line at the bottom of my letter stating 'written correspondence only--no phone calls please'. They take this and chose to hold it against me. Guess now I will write wells fargo about this and see if this is the problem. Also home depot, wonder if this is why home depot didn't write to tell me to start sending my payments somewhere else because they were shutting down their PO box? I've wrote corporate offices at wells fargo, home depot and still got no answers. Now I'm thinking I might know why. It makes me mad that they can turn it around on you like this. thanks shirley

It more a legality issue, than not wanting to talk to you. When you send them a cease & desist letter, thats what it's suppose to do. If you were to call them, and start record the phone conversation half way through, you could say they called you and started harassing you. This is why most collection companies will not talk to you after receiving such letter.

well, I decided to get even more ballsie, and pick up the phone and call home depot. yes I did! get this, they are a citi card just like the other place I called, and they do not have me on a cease and desist. They were very nice and told me where to start sending the payments to every month. They are the 'recovery' department for home depot. and they were sooo cool. They even said the $20 a month is acceptable that I have been sending and if I wanted, this month I could send $40 since they returned my payment last month due to them closing their PO box in atlanta. wow! this is a burden lifted, I don't have to wonder if they were planning to show up at my front door any day. thanks, shirley

In legal terms, this statement allows to be contacted only by mail restricting phone calls only. You might have sent this letter certified which means that the company is having your original letter. Wow! You have a case to prove that the company is shaping things against you. Get the company to prove you how they reacted to your cease and desist letter and if they are trying to cause you any willful injury.
A cease and desist letter when specifically mentions that you want to be contacted only by mail, things should be shaped according to it and not on the contrary. You hold a strong and valid reason on this matter.

What a pain in the butt! I am really surprised at the possibility that a cease and desist letter means that you can't call them either....how ridiculous! I'm sure that legally, it makes sense, but give me a break....now I am definitely interested to see if this is the problem that you are having with Wells Fargo...it does make sense, I guess. Keep us posted on what goes on here!

You don't even know what you're talking about, I never sent them a cease and desist letter and I certainly didn't 'pay' to send it certified---I didn't want to 'settle' up, I have been paying them--duh-and not through a collection agency either. I just called to check my balance with them. Why don't you pay more attention to whats being posted here in the forums instead of trying to find opportunities to 'slam' people, when you don't even know what you're talking about. grow up!
