I filed BK in 1996, I have a letter from the BK court in my possession. I rec'd a call at work from West Asset Managenent trying to collect on a debt from 1992. I told them to send any and all information to my home address, which they have, and to not call me at work. I rec'd a second call today with the same pushy tone and told them to never call my office again.

Do they even have a right to call on a debt from 1992? After filing a BK?


Yes they can try to collect. They can't sue you so, your best option is to send a cease and desist. IF this was included in your BK, you may be able to sue them, however. The bankruptcy discharge is a court order. It says that creditors cannot do ???any act??? to collect a debt that was discharged in the bankruptcy.

:D:DThanks so much for the information. I have sent the cease and desist letter and a copy of the BK Discharge. They keep calling my office and since it PO's me to no end, I have asked an attorney to draft a letter.
