I have been telling this lady that they are illegal in Texas which is where i live and she keeps telling me that they are legal and that i agreed to these high interest loans. I have tried to tell her that i am willing to pay the 300 dollars back to each company but that i want it in writing that the debt will be paid in full, but she keeps telling me that she is going to send the debt to her legal department so they can sue me. The problem is right now i am trying to pay off Check n go and Ace cash express which are both legal in Texas first. What do i do. How long can i go without paying them.

You should pay off the legal payday lender prior to paying off the illegal ones. Once you pay off the legal payday lenders, you should send the principal balance to CMG and Gateway and close down your accounts. You should inform them in writing that they are illegal in your state and thus you've paid them only the principal balance. As they are illegal, they won't be able to sue you. They can only try to scare you by saying that they may take legal actions.

They cannot and will not sue, but be aware they very well may sell the debt to a collection agency and say you owe 2x-3x times as much as the original principle+intrest. Also, since you are in TX contact your state reps and express support for HB 212, HB 410, HB 656, HB 661. Those will close the loophole that CSO's like ACE and Check'N'Go use to screw over people and bypass the standing PDL laws of TX. First off with the internet ones, send them a letter demanding proof of the debt, and a cease and desist letter by certified mail revoking their rights to call or deduct money from your account. Chances are, it won't stop them but it's something.

To the OP, what steps have you taken thus far with these payday lenders? Have you searched the CSO and payday loan licensee data base to see if they are legal lenders?

ACE Cash Express and Check 'n Go are legal in TX in the sense that they operate as CSOs. Pending legislation before the state house right now will eliminate the PDL operating under the guise of CSO's when/if it passes, but for now they are legal. Very few internet PDLs are "legal" under TX law, but that just means they can't really sue you, not that they won't pursue the debt and attempt collections. As one debt holder of mine recently found out as well, there court order garnishment from VA won't hold up or be enforced under TX law. Serves them right for not honoring the full terms of the contract.
