I recently got a phone call from Midland Credit saying I owed (this amount) for a old Fingerhut account. They want me to either make $100 a month payments to pay the bill off or they gave me a settlement of $1, 130.51 to pay by the end of the month.
I told the lady I could do monthly payments but coudn't pay $100 mth. She then asked me if we rented or owned a home then when I told her we rented she asked if my husband had a retirement fund we could get the money from or ask a relative. She said if I don't pay they are going to take me to court or take the money from my husbands work check- I don't work.
I realise I owe this debt, but how can I get it so I can make monthly payments that are manageable to me and my family. Or, should I just find a way to pay this off in a hurry.
I would appreciate any help in this matter.

Before you do anything,you should send a letter for validation of debt,that will give you a little more time.When was your last payment on this account?Make an offer to them after you receive the validation,ask to speak to someone higher up.But first you need to send out the letter,I found two addresses for them.

The complete break down of the principal amount along with the interests has to be mentioned in the validation request. They also need to give copies of your contract signed with the original creditor while this debt was incurred. Along with it, a note of the date of last activity on this account should be attached to verify the statutes in your state.

I just got a letter from them telling me they want a payment by 06/22 for 40% off or the full balance by 06/29. It isn't till the other side of the letter it says I can dispute it.
I am sending out a DV letter but I have read that they don't validate and in fact send letters to debtors asking for validation.
My question is, what do you do after they fail to validate the debt? Can they sue you still? If they do sue can you have it dismissed with prejudice by showing the proof they failed to validate and that you sent a letter to them?

UGHHHHHH. You must be in San Diego. Believe me, I'm from San Diego and MCM are really horrible. First off, they will NOT sue you. Can you afford the settlement? If you can, do the settlement and ask for a Pay for delete letter. once you get that, let me know and i'll post the Big 3 fax numbers for dispute. By using this method, the Big 3 have 5 BUSINESS DAYS to update your account. This will be good for you.

I don't know if this debt is mine and how old it is so I will send the DV letter. MCM is not on my credit reports as of yet. I was reading and they can only put an entry if I don't respond after the 30 days. If I dispute it they can't do a thing.
