About six months ago, I received a call from MRS Associates in regards to a defaulted loan (a car loan). I know that there is a balance owed on this loan and I set up a payment plan to pay it off. When I checked my credit report, it is reported as written off. When I talked to the person at MRS and asked for a statement, I was told that they "don't do paper statements and there was not an account number" . I was given a bank account number to deposit my payment into. I am concerned because I don't have proof that the money I'm paying is going towards this debt. What should I do next? I have suspended the auto pay that I'd set up with my bank. Help!!! Do I need an attorney?


If the account is reported as "written off", then it means that the account has been charged-off. You should not make any payments to the company without any written agreement or document. You should tell the company that you would like to settle the debts. But before making any payments you would like to have a written contract.

You should also have the company validate the account first as well to make sure they are the correct company to pay and that you are paying the correct amount. Once they validate then you set up a written payment arrangement detailing all the particulars.

Tell them that their practices have made you wary and that you will not be making further payments until they validate the debt and you get an agreement in writing.
