i'm being sued by Capitol 1 for unpaid charge card. i went over my limit and had charges. i made many attempts to pay my bill, paying double, triple the amount they wanted each month. but they kept adding charges and i couldnt get ahead. after 8 months, and over $500 i was stil getting charges. so i said screw them. i was getting charges even after they cancelled my card! now i have to go to court. i'm on SSI, i pay my bills, and Capitol 1 is screwing me! they say i owe them over $1200, it should be around $600. what should i do?:confused:


If you have received the court papers, then you should give a reply to the summons asap. Enclose all the relevant documents and payment receipts with your letter. If you have no idea how to answer the summons, then you can consult an attorney. An experienced attorney can help you draft the reply correctly and deal with case efficiently.

To figure out how to answer a summons, look up civil court procedures on your local county website. An attorney will charge you at least a couple hundred bucks to draft a letter...so dont bother.

Your balance is higher because you have been charged the cost of collections...the court and legal fees. That can run $500-600 for filing fees and legal prep work. So your balance sounds about right.
