Wage Garnishment - NJ

Anyway, I was reading through some laws because I have been getting threatening calls from PDL companies and collection agencies. These relate to PDLs that are several years old and all beyond paid off. Anyway, it seems I read that creditors can petition the court for a garnishment without me ever knowing...is this true? What can I do to prevent this?

If the pdls have crossed the SOL period as per your state laws, then the collection agencies won't be able to take any legal actions against you. Thus, they won't be able to garnish your wages. They are just trying to scare you so that you make the payments.

I guess, they can???t do that. At first, they will have to file a lawsuit against you. After that, you will receive a summons from the court, which you will need to give a reply. If the court issues a judgment against you, then only the CA may get the right to garnish your wages.

no they can't petition the court to garnish without your knowing.what the illegal pdl's are reffering to is a wage assignment.that is totally voluntary and revocable.in fact get a wage assignment revocation letter to your HR/PAYROLL person.btw your state laws apply in every case here.meaning pdl's are prohibited in NJ and the pdl's wouldn't have a prayer in court.submit the letter,and ignore these places when they call.
