I got a call yesterday from a private number. I answered it thinking it was someone else. It was a 3rd party locating service, or so they said. They told me that they were hired to serve me with papers for a payday loan I defaulted on. But that if I called United Check and spoke with Gregory Kogler I could have the papers stopped. I did call him and he said that I owed Kenwood Services $415 and that they needed arrangements to be made right then or I would be sued. I went to my county website and can't find anything filed with my court. I also looked and the website states that the lawsuit must be filed for more than $500 and they said it was $415. I am just wondering if they really have papers or if it was just a scare tactic to get me to pay. I haven't paid anything yet but they did scare me. I am going to call the courts first thing this morning to see if they can serve me with papers before even filing with the court.

Any advice on what I should do.

it is a definite scare tactic.first file a police report for the call as the initial call broke the law.no process server would call ahead.then use the number you have to file AG AND FTC complaints.again the law was broken here and it needs to be reported.btw service procedures vary by state, but a suit must be filed before you are served.check with your court clerk website for the procedures in regards to service.
