my son took a payday loan with Lakota Cash. I found out they are illegal in our state. He sent them a letter regarding this and they still are trying to debit his checking account, resulting in hundreds of dollars of NSF fees. They try at least twice a day to debit his account. They are threatening to garnish his wages. Can they do this?

1)no matter what they say they need a court order to garnish.they will try a WAGE ASSIGNMENT.that is not a garnishment and is voluntary and revocable.have your son draft a WAGE ASSIGNMENT REVOCATION letter and first give it to his HR/payroll person.
