From what I've read there are different ways collection agencies settle debt. What should I be asking and how do I want this reported?
I'm not against paying the original debt amount or some other amount mutually agreed once I know what it owed.
For the first time in our lives we are up to date on all Utility bills I would like to start eliminating old consumer debt and don't want to make any avoidable mistakes. FWIW we are not accumulating any new consumer debt. 8-)

Plus they do not have to provide you with a complete payment history as part of validation or verification, nor do they have to provide any agreement with the client. (Read the FDCPA as to what constitutes validation.)
Sending a copy of that letter only shows you know how to cut and paste....not that you have any understanding of the law.
Use plain english...."I request validation/verification of the debt per the FDCPA" Or "I demand you cease and desist all contact with any third parties per the FDCPA" You do not have to explain it to them.

I am here to help....but sending out a letter that YOU do not understand is not helping you. You have to learn to help yourself when getting out of debt by reading and researching.
Do you owe the debt? Is it in SOL? What type of debt? What state do you live in? Date of last payment?

It is credit card debt.
I think that he does owe a debt to Capitol One who is listed on the collection notice.

I found online that the SOL in PA is 4 years, I'm not exactly sure when the last pmt may have been made. I will ask him if he can remember with any certainty. I can tell you it has been a few years. He did receive a docket from the sheriff regarding capitol one in the summer of 2009, he hadn't made any payments for sometime before that. I think he signed that he received the docs at the sheriff's office but did nothing once he got the papers.

Sounds like they got a judgment against him...the SOL would restart when the judgment was rendered....4 years...and it can be renewed. So it could go until 2017 or 2018 depending on the date. His wages cannot be garnished in PA but bank accounts can be seized as well as leins on property.
You might want to look up the court case on your county courts website. Ignoring a summons is not a good thing.

Not being rude....just wont sugar coat the reality of debt collections. You want me to hold their hands and poo poo their debts? People have to learn to pull up their shorts and be proactive ....we can give them tools and direct them in the right direction but ultimately THEY will have to solve their debt problems. And along that collection path, they will probably meet some real ass jerk collectors....which will make me seem like a pussy cat.
So climb back under your rock....

It sounds like you are in a better position to deal with your debts then a few years ago so I hope that you can get this cleared up. I was in your position a few years ago and now am finally seeing the light and it is a good feeling. But I do agree with Soaplady - ignoring things will not make them go away. mind if i cut in?being as one person is in PA,and the other is in NC the issue is not about validation,but this "supposed" loan was illegal anyway.what number comes up on caller id?that would help.btw chances are your name and number were used as a reference.again immaterial,what is material is they are calling and illegaly threatening for an illegal debt as again pdl's are prohibited in both NC,AND PA.file AG complaints,and yes SOAPLADY is right in a sense that illegal bottomfeeding internet lenders,and the scum who call on them don't care about the law and would ignore a validation request and most likely a c&d as well.file the AG complaint and don't engage them.a waste of time.one more thing.NCO won't abide by the law as they one of the worst out there as far as harrassing bottomfeeders.

well your husband's brother could have used you as reference.either way you don't want verification as i can verify right now on this forum.verification is very liberal and easy to do.all they will do is type up a paper stating you owe this and to pay them.that's verifiation.you want validation.a totally different animal.re-word your letter to state that and yes try not to make it look cut and paste.use your own words as much as possible.send it certified mail return receipt.last thing be prepared to file AG complaints as they really don't abide by DV,or C&D letters as they have been sued quite a bit,but usually settle out of court.get the letter out asap.
