We had a debt that was arranged three years ago one day prior to going to court because of a summon. We have met this arrangement down to the last dollar except $43.00 which the collection office will not take because they say we owe more. According to our records that is not the case. However, we have since found out that even thought we made an arrangement and did not extend an answer to the court a judgment was filed. It is the 8% interest on the judgement that is in dispute, one because we did not know about it, and it was never communicated to us ever. Now they have issued a garnishment for funds. Is this legal and can we fight it?:p

You are not going to be able to dispute it....even if you had shown up in court, the creditor probably would have gotten a contingency judgment....an agreement not to take legal action against you provided to make the payments. Pay it and get it over with.

You really are not in a position to make demands...you either pay it or they garnish. They have the court order. Garnishment I believe comes with additional costs. Dont know if you get anything....your credit report will reflect paid judgement.

They have already garnished the amount they say we owe. We are just frustrated because we have done everything they asked but this last little part was never communicated to us in any way and we feel blind sided. When we pay this we have paid everything as far as they have said so I guess my question is can they blind side us again or are their hands legally tied at that point.

In three years, have you not checked your credit report and seen the judgment?? You should also have received notice from the court about the judgment after it was rendered.
