I just received a letter stating that my bank account would be garnished for a judgement (unpaid credit card debt) that I was not aware of. The original judgement was dated Aug of 2008 in Washington State, where I used to reside and still own a home. I now live in Oregon and have for 7 years. My PO box where I received the letter of garnishment is the same one I had in Aug of 2008. Why was I not served? Do I have a leg to stand on here to vacate the judgement?
Secondly, my bank account had $50 in it. They took out $75 which left me with a negative balance and overdraft fees because of the negative balance?! Is this legal to overdraw my account? I do not use this account much so it was overdrawn by them--not by other payments trying to post after they took the money.
Thirdly, how can I know if there are any other judgements against me? Is there some way to check this?
Thank you so much.

You can apply in the court for vacating the judgment. It might be the case that you didn't receive the court papers due to the address problem. May be the court papers were sent to your Washington address. This is why you didn't get the court papers. Since you didn't give a reply to the summons, the case went against you.
Go through your credit report to know whether or not there are any other judgments against you.

Thank you for your response. I have been checking my report for the last couple of years and saw no evidence of judgement, but maybe I just didnt know what I was looking for.
